The evidence of the crime is irrefutable and two criminal counts apply because two vote records were altered.
That this rises to a Texas Jail Felony seems certain given the statutes (see below).

Reading posts and news following Sen. Wendy Davis' successful filibuster reveals a conspiracy led by Texas Lt. Gov. Dewhurst.
The obvious implication is the end of his political career. At the least, his resignation should be sought immediately.

Davis says voting documents altered after filibuster

Sen. Wendy Davis told CNN’s Anderson Cooper that a fellow senator was informed by a Capitol staff member that the official voting documents had been purposefully changed to falsify the time of the vote on SB 5, the bill killed in her dramatic Tuesday night filibuster.

The discovery was important, she said, because had the vote been stamped on 6/25, rather than 6/26, the bill would have passed.

“We know it was purposeful,” she said. “I think there will be further investigation.”

(3) intentionally destroys, conceals, removes, or otherwise impairs the verity, legibility, or availability of a governmental record;

I see no reason it can't be discussed on DU. That seems to be the case in TX.
When there is no evidence of a conspiracy but only wild speculation, like in Hasting's death, then such CTs should be in CT forum.

Oh, I doubt he'd be in there too long, just enough for his suits to fit badly when he got out. It would be very nice if they made an example of blatant fraud.

But they won't, of course, this is Texas where swaggering criminals just get elected again and again and again.

The sitting DA is serving a 6 month sentence for DWI (DUI) Perry tried to force her to resign so he could appoint one of his cronies. She refused and he cut off the state money that funds the investigation of these kind of crimes. So the Travis County DA office has the authority but no money to act on it.

they still have jurisdiction over crimes in Travis Co. The Senate chamber is in Travis Co. It just means they don't get any extra state funds to augment their investigation/prosecution.

...in Georgia that as the witching hour approached signaling the end of a legislative session, the Speaker - famously a tough, old Democrat that, in essence, ran the State - would simply stop the 'official' clock in the Chamber until they had dealt with all e business at hand.

Essentially the same legislation was recently enacted in my state, Alabama, and the effect will be closure of virtually every clinic providing reproductive services to women. Don't think for a minute that the battle in Texas is over, especially since Rickey Boy has a special session scheduled next week.

The law is no obstacle to zealots who believe that only they know what's best.................Bush country indeed

and on the Democrats while ignoring the rules himself. His ruling to the Points of Order that stopped Sen. Davis from speaking were so arbitrary and ill-founded that they are laughable.

IT IS TRULY FITTING THAT THE SAME STRICT STANDARDS NOW BE APPLIED TO HIS BEHAVIOR.

Who has video of his statements about strictly adhering to the rules?

Wendy sent me an email informing me she would be on AC360, however, she didn't mention Chris Hayes.
I thought it was more informative and Anderson actuality brought up the timestamp discrepancies. Now at least on a national scale the info is out there.

I started a thread about it, however, no one rec'd it or even posted on it, yet Chris Hayes got more coverage here. Go figure! I like Chris but his interview after watching it didn't do anything for me, I thought it fell flat.

It can be so frustrating that the republicons can get away with this betrayal of democracy whenever and however they want, yet they rise hell when they decide to create the illusion that Democrats do the same thing.

As a precinct chair in Tarrant County (unfortunately, Wendy isn't my Senator), I have to work under the presiding judge who is a republican. At least he acts like he wants fairness and justice. I suppose I need to get his views on the time stamp conspiracy, as I would love to know what his thoughts are on it.

In a Wednesday interview on MSNBC's "All In With Chris Hayes," Davis was asked to respond to Perry's "decorum" remark. She struck back at the governor and Lt. Gov David Dewhurst, panning them as the ones who "led the charge" on the decorum breakdown.

especially so with the whole world watching.

Assuming the AG was not one of the conspirators, why risk your own future and act criminally yourself to prevent a known crime from being brought to justice. If anything, they will try less obvious tactics, like loading a grand jury.

Good grief, they can easily change timestamps, votes or damn near anything. How ludicrous. Just having the capability of doing that is monstrous and ripe for tampering. What other votes or timestamps or whatever have been changed before in order to sabotage a vote?

The fact that Repubs were so casual about it tells me that this is something that happens all the time and goes unnoticed and/or unaccounted for.

The clerk also needs to be punished in some way for agreeing to changing the record and physically doing it. Did this person even say anything to anyone? At the least they need to lose their job.

All the way from the Lt. Gov. (and maybe Governor Perry) down to anyone performing the computer alterations. Also, the written record needs to be examnined becuase we know that entry said 12:02. You can bet they changed that too.

Losing their jobs is not enough. This is a jail time felony, and, given how they sooo enjoy strict adherence to the rules .... let's be as strict as possible.

In the chaotic moments following the vote on the abortion restriction bill after Sen. Wendy Davis’s filibuster, the Texas Legislative Library’s first official posting of the vote indicated it occurred on 6/26. A few minutes later, the date mysteriously was reset to 6/25. Which was correct? It makes all the difference in the world. If the vote occurred on 6/26, the special session had ended at midnight. The vote wouldn’t count.

Did gremlins change the date on an official state document to bolster their argument that the bill passed? Some senators, including Davis, suggested earlier this week that question called for a thorough investigation. Here’s ours:

Who’s in charge of the Senate’s official documents? That would be Patsy Spaw, Secretary of the Senate, who not only calls the roll, but oversees all the official record keepers. The document in question was actually produced by the Texas Legislative Library for public research purposes.Their staff members sit next to Spaw’s staff and follow every official vote.

Oh never mind,i forget,we as good progressives are supposed to look forward and not back.
Forgery of a government doc? That is small time stuff.
Arrest that guy with a marijuana stem in his pocket though,there is the real criminal.

Texas state Sen. Leticia Van De Putte (D), one of the lawmakers who stood up and defended Sen. Wendy Davis (D) after Davis' 11-hour filibuster of an anti-abortion bill on Tuesday, said the federal government will likely investigate Senate Republicans for changing the timestamp on official government documents to indicate that the bill had passed before the legislative session had ended.

"I think there will be an investigation," she told The Huffington Post in an interview. "You can't try to change a government document. The length they were willing to go to to break Senate rules -- tampering with a government document? That's a felony."

...... "They got caught by the media and by everyone trying to change the time at which the bill passed, and they didn't know how to get out of it," Van de Putte said. "I think that Republicans severely miscalculated if they thought women would go quietly into the night as they tried to pass this egregious bill."

Dewhurst's office did not respond to requests for comment ......

In a desperate effort to pass a controversial bill that would shutter abortion clinics in Texas, a slew of Twitter sleuths, including Circa's Anthony De Rosa and former Reuters social media editor Matthew Keys, discovered that the state legislature altered official state documents to show that the vote was passed before the midnight deadline.

In actuality, the Texas state senate did not pass the bill, SB 5, in time—thanks to defeaning cheers from the gallery from supporters of State Senator Wendy Davis, who spent more than 10 hours filibustering a vote.

"Over 170,000 of us watched the Texas GOP [on YouTube] *Break the Senate rules*, and mainstream media is ignoring that fact," writer Wil Wheaton tweeted.

Ultimately, it appears the timestamp of last night’s Texas abortion bill (SB5) vote killed the legislation after what may have been an attempt at possibly illegal shenanigans arrested by social media.

The Texas abortion bill timestamp controversy, dubbed “timestampgate,” trended alongside SB5 as Twitter users watched developments late into the night of Texas State Senator Wendy Davis’ filibuster.

Initially, it was announced that a vote on SB5 had passed and Davis’ lengthy stand had been for naught — but then Twitter sleuths unearthed an interesting find on official records of the vote posted on the internet.

It was a monumental event that hit Texas last night, and it appears big media barely played a role in it.

That saying ‘Don’t mess with Texas’ took on new meaning in the early hours of Wednesday as the capitol building was figuratively turned upside down and practically taken over by the people. The end result: a defeated controversial abortion bill, a new hero for women’s rights and perhaps another big turning point for the power of social media.

Texas Democratic Senator Wendy Davis led the battle cry. In her pink lace-up running shoes, she stood for nearly 11 hours without a bathroom, water or food break in an attempt to filibuster that bill known as #SB5. And it appears the people were “standing” with her. Even President Barack Obama was among those telling people to tune into Texas.

While her filibuster fell short of the 13 hours she was aiming for to kill the bill, the cause was then taken up by loud cheering and chanting from protestors who filled the chamber and halted the voting for what some said was up to 30 minutes. Republicans, who control the Senate, say the bill passed with seconds to spare, but hours of confusion then ensued as the two sides went back and forth over whether it had legally passed. Social media erupted with alleged proof that the vote on that bill came after the midnight deadline. .....

(d) An offense under this section, if it is shown on the trial of the offense that the governmental record is described by Section 37.01(2)(D), is:

(1) ....

(3) a felony of the second degree, notwithstanding Subdivisions (1) and (2), if the actor's intent in committing the offense was to defraud or harm another.

(g) A person is presumed to intend to defraud or harm another if the person acts with respect to two or more of the same type of governmental records or blank governmental record forms and if each governmental record or blank governmental record form is a license, certificate, permit, seal, title, or similar document issued by government.

...

(i) With the consent of the appropriate local county or district attorney, the attorney general has concurrent jurisdiction with that consenting local prosecutor to prosecute an offense under this section that involves the state Medicaid program.


The obvious implication of (i) is "the appropriate local county or district attorney" has prosecutorial jurisdiction. That still leaves open who has investigative responsibility, in my view, but certainly the local DA cannot ignore this one..

I include (g) also to point out that this rises to the level of a felony.

.... Davis also addressed the time stamp on the final vote, which was initially changed on official records to falsely indicate that the vote had taken place before the midnight deadline, telling Cooper: “I know it was done intentionally.”

Answers remained unanswered .... Senator Wendy Davis ... "I know it [the time change] was done intentionally based on a conversation that one of my Senate colleagues had with the office that actually puts that online or makes that information available. And he was told by them when he asked why it was changed that they were instructed to do it."

Senator Leticia Van de Putte has also called for an investigation to be done:

"The false explanation purported by Legislative Reference Library ... Real-time data captured by the world over the Internet confirms the vote was after midnight. As well, it was after midnight on a parliamentary procedure and not move to concur in House amendments. By their explanation they allege that the Internet and speed of sound in the chamber all run 3 minutes behind reality. People, keep your eye on the injustice to democracy being established by this uncharted precedence. This a an example of why the US Supreme Courts ruling on the Voting Rights Act was the wrong decision. It emboldens coward and bullies to manipulate systems of transparency without fear of repercussion. They must truly believe we are all illiterate to democracy, freedom and justice."

What can we take from this? David Dewhurst and his cronies think all they have to do is make the LRL send a brief statement and that it'll blow over.

The pressure should continue, especially as we move into the second special session. The Texas GOP has broken enough rules. This could actually be an instance they could truly be reprimanded legally.

Dear Attorney General Holder:

I write to you out of great concern for the people of Texas and to make a request for your expeditious attention. As you may know, on 25-June-2013, the Texas State Senate held a late evening session regarding senate bill SB-5 — that unlawfully extended into the early morning hours of 26-June-2013; beyond the session’s legal expiration. The full hearing and subsequent vote was carried live on the internet to the witness of hundreds-of-thousands of watching Americans . The subject of the proceedings related to womens’ health issues and their unimpeded (first trimester of pregnancy) availability to abortion options, as guaranteed by the U.S. Supreme Court decision in: Roe v. Wade, 410 U.S. 113, 93 S. Ct. 705, 35 L. Ed. 2d 147 (1973). To the shock of a nearly incalculable number of Americans watching the proceedings, Texas Republican lawmakers held an untimely vote in direct violation of the standards set forth in the state’s constitutionally adopted procedural rules and guidelines. In their unabated haste and with full knowledge that the session had expired, an unnamed party or parties attempted (as the evidence of public records will show) to illegally alter the recordation of the time and date stamp associate with the vote; attempting to reflect a timely democratic process undertaking. After several hours transpired an announcement was made declaring the vote invalid.

Over the course of six days, thousands of witnesses have come forward to petition Texas Attorney General Greg Abbott, to open an investigation to determine the party or parties responsible for altering the vote’s time and date record without success. It is the consensus of many Americans: that members of the Texas state senate did willfully conspire to commit aggravated perjury and did feloniously tamper with Physical evidence. The individual(s) responsible, made an unlawful effort to disenfranchise the citizenry of the State of Texas. Further, given Attorney General Abbott’s blatant inaction, which has generated serious concern of complicity, the undersigned petitioners are requesting: an immediate and comprehensive criminal investigation be conducted by the appropriate federal agencies.

Mr. Attorney General, it is with our utmost courage that we must hold our lawmakers accountable for actions that clearly violate the peoples trust, and we the signers of this petition believe this is one of those example making instances. The fact that the outcome of the vote on ("SB 5&quot has been deemed untimely, does not negate or preclude the opening of an investigation or its eventual findings.
