Defense wins round on WikiLeaks helicopter video

... The judge, Army Col. Denise Lind, took judicial notice of the document during Manning's court-martial at Fort Meade in Maryland. Judicial notice is a preliminary step toward admitting evidence.

The document is an assessment by a former U.S. Central Command official of video showing a 2007 U.S. helicopter attack in Baghdad that killed at least eight people, including a Reuters news photographer and his driver. His assessment was that the video should be unclassified.

That contradicted evidence offered by prosecutors. They have presented an assessment from a Pentagon official that the video revealed military tactics, techniques and procedures.

Manning has acknowledged he gave the video to the anti-secrecy website WikiLeaks but denied revealing national defense information ...

... The Pentagon's investigation cleared the pilots by saying that they confused photographer's cameras with guns.

Reuters placed a Freedom of Information Act request to conduct its own investigation into the matter, but the military refused to provide the footage of the incident.

In a public statement before trial, Manning testified that he learned about the video while he was stationed in Iraq as an intelligence specialist ...

He claimed that he knew Reuters wanted the video, and that he was going to send it to them directly before uploading to WikiLeaks ...

Hopefully this is another step towards getting all of this questionable secrecy challenged. The fact that the crew of the helicopter were cleared of wrongdoing previous to this is sickening...but it's also proof of the policies in place.
