Suspected drunk drivers in some metro counties are getting a rude surprise when they refuse a breathalyzer test.
Instead of taking no for an answer, officers now obtain a search warrant to forcibly draw blood and get evidence for the case.
The key word: forcibly.

(14,732 posts)obtaining a drivers license you agree to submit to testing for DUI. If you refuse the breathalyzer the police may then obtain a warrant from a judge to get a sample of your blood for testing. Sometimes the (usually bombed) driver wants to 'refuse' to give a blood sample. At that point the driver can be restrained and the sample taken by qualified medical personnel. It's not the cops who take the sample.

(32,013 posts)In my state the local police always have a 'duty judge' who they can call and get a warrant to draw blood. It doesn't matter if it is 3am or anytime.
