SCOTUS set to give Thomas and extra half hour of sleep.

Last edited Tue Feb 21, 2012, 06:22 PM - Edit history (1)

They increased the time for next month’s oral arguments on the Health Care Reform Act from 5.5 hours to 6 hours to discuss the application of the Anti-Injunction Act. This act states that they can't rule on a tax that is not yet in effect. But the White House claims it does not apply because it is a penalty and not a tax. It seems that SCOTUS wants it to be considered a tax and has hired lawyers to convince them that it is. If that succeeds, and since it is not in effect until 2014, they might actually postpone their decision until next year.
