A New York appeals court has upheld a ruling striking down New York City Mayor Michael Bloomberg's latest health push: his controversial ban on large sugary drinks. The ban, which would have prohibited the sale of sodas and other sugary beverages larger than 16 ounces by restaurants and city eateries, was an illegal overreach of executive power, the state appeals court ruled Tuesday, upholding a lower court decision in March that struck down the law.

A state supreme court justice in Manhattan had ruled the new regulation was "arbitrary and capricious" in March a day before the regulation was due to take effect, ruling it invalid after the American Beverage Association and other business groups sued New York City, challenging the ban.

When the taste-testers knew which version they were drinking, the overall consensus was that the Mexican version, while more watery than its American counterpart, tasted more 'naturally sweet'.
By contrast, the high-fructose corn syrup-infused beverage was said to have a more 'synthetic' taste. 'It makes your mouth feel sour and bitter,' explained one person.
After sipping the two drinks from unnamed cups, however, half of our taste-testers said they preferred the Mexican Coke, while the other half stuck to the American version.

Bloomberg aimed at the wrong target - and missed. And how many taxpayer dollars were wasted by this fool's errand?

Everything in moderation. The balance may be hard to find sometimes, but it doesn't mean we should let corporations determine what we shove into our eat-holes without batting an eye.
