Lawyer: San Diego mayor never got harassment training, city may be liable
(CNN) -- A lawyer for San Diego Mayor Bob Filner criticized the city for not providing sexual harassment training to the mayor, saying its failure to do so violated the law.
In a letter to the city attorney, Harvey Berger wrote that Filner might never have been sued for sexual harassment had he been properly trained.
"If there is any liability at all, the city will almost certainly be liable for 'failing to prevent harassment,' " Berger wrote in a letter dated Monday and obtained Wednesday by CNN from City Attorney Jan Goldsmith.

(3,596 posts)at my private employer last week. I have subsequently learned this is because there is a consent decree with the EEOC about an incident involving a physically challenged employee.
I agree with other comments that the city did not hire the mayor. He was elected by the people so I don't know how much liability can be imposed on the city since he wasn't hired by the city and the city has little control over his actions. But that is a matter for lawyers that practice in this area to discuss and comment.
But this is just nuts. He doesn't know that he can be guilty of crimes or at a minimum be subject to civil suit for unwanted sexual advances? Come on. Of course he knows this. He just thinks because he is an elected official he should be able to get away with it. It is disgusting.
He needs to resign and have a serious talk with himself about what he wants to do with the rest of his life and what kind of legacy he wants to leave.
