Texas(!1) gun rights advocate gets arrested for rifle, "Open Carry" or provocation?!

So apparently these ostensible gun rights advocates have been touring Texas, informing local law enforcement that they plan to walk a neighborhood or get their picture taken in front of police stations, with a “long arm” (rifle) slung with a strap on their shoulders, and the gimmick is that they are “educating” law enforcement and the public that in Texas this is permissible while handguns require a permit and be concealed. Apparently it doesn’t matter that some of the public might be ALARMED, because they are considered to be uneducated about the rights and the law. So when similarly uneducated police perchance arrest them, the municipalities are slapped with “multimillion dollar lawsuits.”

These are assorted Libertarians, militia, Ron PAUL, secede/Texas, 2nd Amendment, doomsday preppers, food additives paranoia, “Open Carry Texas,” “Come and Take It,” "Don't Comply," radio talkshow wingnut Alex JONES.

This is NOT about “education,” it’s about PROVOCATION, and sounds to me to have an element of a sweet scam to file “multimillion dollar lawsuits.” Why don’t these dudes need to spend some time on family and a job instead of traveling around provoking law enforcement?

In their YouTube videos, they gather around, "being normal," "window shopping," being ever so nice and well spoken, just BEING NORMAL with a rifle slung from their shoulders, shlubbing around because it's THEIR RIGHT. I *don't* have a right to be ALARMED.

McALLEN — Organizers expect more than 100 gun owners to gather Saturday at the McAllen police station to protest the arrest of a gun rights activist who sought to photograph himself outside the Police Department with a rifle slung across his back.

Zach William Horton, 37, had been traveling for work throughout the Rio Grande Valley, stopping at various police departments along the way and taking photographs outside them with his rifle. ....

Horton had arrived at the McAllen police station at 6:30 p.m. Wednesday and told officers that he wanted to take photographs with a rifle, according to a McAllen police news release.

Police told him that he couldn’t and asked him to leave, but soon after he returned and was arrested, police said. “Horton was stopped as he exited his vehicle, Mr. Horton had a knife in his waistband and previously declared that he had with him a ‘loaded high powered rifle,’” according to the release.

Horton was told to step away from the vehicle, and after he didn’t, police pointed their guns at him and arrested him on the charges of trespassing and carrying a weapon in places where weapons are prohibited because the police station also houses the city’s municipal court, the release shows.

On Thursday the trespassing charge was dismissed and Horton was formally charged with one count of carrying a weapon in places where weapons are prohibited; his bond was set at $25,000. Horton was sent to the Hidalgo County Jail. Members of Open Carry Texas were working to get him released on bond Thursday evening. ....

The organization was started by C.J. Grisham and a few of his friends after he was arrested in March in Temple, Texas, after carrying a rifle while hiking with his son on a rural road. Grisham was initially charged with resisting arrest, but according to him, the charge has been downgraded to interfering with the duties of an officer.

“I have since slapped them with a multimillion-dollar lawsuit,” Grisham said. “We are looking at a lawsuit against McAllen for illegally arresting one of our founding members.” ....

Prior to his unlawful arrest, he was making his way through the southern portion of Texas, stopping at police department after police department, taking pictures in front of their department, showing their support for the 2nd Amendment and an individual’s right to bear arms.

Sergeant John Samples of the Little Elm Police Department was informed that Zach Horton was planning to do an open carry walk with a long arm in his neighborhood and decided to stop by and talk to him about it.

Unfortunately for Sgt. Samples, he doesn’t know the requirements of the law. Under Texas law, open carry of a handgun is a criminal offense, but open carry of a rifle or shotgun is not, unless it is carried in a manner “calculated to alarm.” To Sgt. Samples, this means if the police receive one single call, it has alarmed someone, and the individual has committed an offense.

This is not the case. ....

You’ll also notice that Sgt. Samples is “troubled” that Horton doesn’t just roll over and accept what he is being told by a police officer. Again, this is due to a police mindset – I just told you what to do, I’m a police officer, you have to do what I tell you, even if I’m wrong.

Horton is prominent on the website “Don’t Comply” also known as “Come and Take It America“. This is sort of a whackjob site, with articles on the “Voluntaryist” philosophy, which is just another term for the sovereign citizen-type idiocy that seems to be growing. ....

in Texas. Currently, the law allows for open-carry of long guns in public when transporting arms to and fro vehicles & houses, repair shops and accessorizers, ranges, hunting sites, etc. These cases may serve to tighten up language. If the action is civil disobedience per se, the "lawbreaker" must be prepared for appropriate penalty and punishment.

has been subject to debate for the last several years; in 2006(?), the Texas Rifle Association worked with the Texas Civil Liberties Union to clean up the antiquated and abusive laws concerning weapons transport within the state. Now, hunters & sportspersons aren't subject to arrest for having a goose gun in the backseat in one county, but not bothered in another county. It's an on-going process.

...that Texas doesn't permit full open carry. That "transportation only" bit seems out of character for a state with otherwise relatively unrestrictive gun laws.

but is acceptable in some other states. Until a couple yrs ago, open-carry of unloaded guns was legal in Cali(!). With an effective ban on that now, and a hit & miss ban on concealed, the state faces legal challenge for excessive restrictions on Both means of carry, IMO.

Having grown up in the West (and I live in Portland, OR), I'm used to open carry being legal, and for some reason I assumed that was also the case in the Southeast. It's very uncommon here, but legal.

I see no pushback from the people in Texas.

Millions of people can make a huge difference if they really disagreed with Texas law.

Perhaps you only speak for yourself or are you the designated spokesperson for the State of Texas or Texas Democratic party?

Let's see: Misfits from their own country asked for permission from another country to live there and agreed to conform to that foreign culture and religion, then eventually felt entitled to take that piece of country by force.

And as for that flag (from the Wiki link: ) "Mexican authorities gave the settlers of Gonzales a small cannon to help protect them from frequent Comanche raids. Over the next four years, the political situation in Mexico deteriorated, and in 1835 several states revolted. As the unrest spread, Colonel Domingo de Ugartechea, the commander of all Mexican troops in Texas, felt it unwise to leave the residents of Gonzales a weapon and requested the return of the cannon.

When the initial request was refused, ..." the thumbing of the nose at Santa Ana ensued.

i live in texas. i own guns.
the thought of carrying an assault rifle openly down the street makes no sense to me. why?
even taking any law for and against it out of the equation why would you need to carry a rifle down the street
if your that scared that you feel you need a rifle where your going your probab;y better off not going there

I have to ask why a courthouse or legislative building should receive a higher level of gun mitigation than a shopping mall. If it is indeed up to the place of business to dictate such terms, than I call on interested people to refuse the goods or services of business that does not invoke the same level of prohibition as a courtroom.

IOW, with or without a court (?) inside the building, these dweebs can STAY OUTSIDE, in the parking lot, on the grass, wherever.

However, I don't get why, in one of their recent rallies, they were congregated IN THE MIDDLE OF THE PARKING LOT, thereby OBSTRUCTING ACCESS. Isn't access for the public/business NOT to be obstructed?!1 But it looks like they have the cops thoroughly cowardized.

Making threats against judges & prosecutors. You'd be surprised just how hostile people get over a $10 parking ticket. As for county & federal court houses, that's where murderers & other felons are prosecuted. Makes sense to keep guns out, except those carried by law enforcement

What is good for a judge is good for my next door neighbor.

There is no boundary for crazy. It isn't exclusive to those that enter the courtroom.

If a person is angered enough to threaten over a parking ticket, they are angered enough to threaten anybody, over a multitude of reasons. Murderers and felons spend far less time in a courtroom, than they do amongst the general population.
