The following two paragraphs refer to BREAKING BAD and may have spoilers for folks who haven't seen the latest episode...
So anyone wondering whether Hank putting a tracker on Walt's car could lead to admissible evidence... yes, it could.
Hank's looking at Walt's copy of Leaves of Grass might also be okay, since Hank was allowed to use the bathroom, and our modern courts would probably find looking inside the book to be 'plain sight' enough... particularly since Hank wasn't in the bathroom in an official capacity. But Hank's warrantless seizure of the book was a problem. He should have taken a cell-phone picture of the inscription to compare the handwriting with and then gotten a warrant for the book itself.

(17,742 posts)but Walt putting that book in his bathroom is one of the biggest. Yeah, I know the whole "he subconsciously wants to get caught" excuse, but the writers could have been more adept. It just seemed too clunky to me for such a well scripted show.

(15,189 posts)I watched Breaking Bad last night here online. Sometimes these channels are down, some have rude commercials that keep going off every minute. The link above had none of that. Weird start times, but worth it. I also watch MSNBC here too.
