if the average surcharge for smokers is 15% why is the cap 50%?

Insurance companies rarely charge over 15% surcharge on smokers because they don't want to lose their business. Why then is ACA putting a 50% cap on surcharges? Why not make the cap much lower?

Any benefits to customers were included there by accident.

And they gave me Chantix. Second week still smoking, but I still have another 2 weeks to go. I would suggest anyone who needs to quit smoking and doesn't have insurance, to seek out a free clinic.
