A teen accused of having sex with her underage girlfriend will remain in jail until her trial.
A judge ordered 19-year-old Kaitlyn Hunt to be held without bond during a hearing Tuesday. Hunt was booked into the Indian River County Jail Monday night, facing a new charge of transmitting material by electronic equipment harmful to a minor. She was already charged with two counts of lewd and lascivious battery on a child.
Authorities say Hunt had sex with her then-14-year-old girlfriend last year. Hunt argues the sex was consensual.
Scripps Treasure Coast Newspapers reports that the state attorney's office pulled a plea offer Monday following allegations Hunt violated her pretrial conditions and contacted the girl identified as the victim in the case. Prosecutors say Hunt exchanged thousands of texts with the girl and sent her nude photos.

(33,915 posts)Laws which criminalize sex between members of the same peer group (e.g. within the same high school) based solely on age are wrong. As I have maintained all along - such sexual activity should be evaluated based on the reality of the interactions, not because a calendar says it is rape.
It also appears that Kaitlyn is dumber than a box of rocks. But that doesn't change my position on the principle.

(15,064 posts)I really have no opinion. I know child labor was legal and outlawed. I also know of very young teenagers that have sought and gotten legal emancipation from their parents because they were older beyond their years. I had never heard of that until a few years ago. There was one teenager I knew of who wanted to enter into a contract for a career but did not want a parent involved because the parent was not stable. My understanding at that time was that they then legally became a consenting adult. I personally think 18 should be the age of consent because a person can die for the country in the military but not be of legal age to drink alcohol. What the norm should be actually I think should be determined by medical professionals and not someone like me or a politician.

(19,497 posts)We can argue about whether or not that is fair/sane but I can't help but wonder if the public outpouring of support (which I was inclined to join) might have left her with the misapprehension that she was untouchable. She was already in trouble with the law and then she defied the judge's explicit instructions/legal orders and engaged in an activity that would land any 30 year old man in prison for decades.
I've no desire to see her life destroyed but -- damn -- she eff'ed up...BIG TIME.

(8,303 posts)and even less so once the court intervened. Once the court intervened it became acutely criminal behavior.
This is way more than "having sex". There's an intensity in this relationship and a risk-taking behavior that's extreme and disturbing.
You can't expect a 15 year old to be wise in love, and if the 19 year old can't control herself for a year and a half until the 15 year old is of legal age, then you have a very real problem.
Nor can I really see this as a "love" relationship at this point, because I was a 19 year old at one point, and although no one is really mature at 19, a 19 year old in love is capable of both discerning and protecting the welfare of the person whom they love.
Ms. Hunt's behavior was reckless and endangered her, but if she really loved the younger girl, she should have had the wisdom to back off until the younger girl was 16 out of concern for the younger girl, even if not for her own sake. Also, I could understand texting "how are you?". but sending nude pics is not about concern for the younger girl. It's just not. It's about maintaining sexual focus.
I have to say that if I found out that my fourteen year-old daughter had banged someone in the school bathroom, I wouldn't permit the relationship to go on without very sharp limits. That's not healthy and it's going to run my kid into trouble, and it indicates a degree of intensity that indicates she is quite likely to get into trouble if I don't set some limits. Supervised contact would provide a chance for any real attachment to either safely mature or fizzle naturally.
Sex is intense and love is intense, and how such relationships will work out really depends upon both parties. In this case, one of the parties now appears to be a self-destructive loon.
The bottom line is that Ms. Hunt seems to have escalated this right down the line. When the younger girl's parents first told her to back off, she could still see the younger girl at school every day. They could have hit the pause button, had an obsessive and devoted relationship and moved on to a highly sexual relationship in less than two years, which was to some degree necessary anyway, because Ms. Hunt was going to be graduating and going on to college. But no, Ms. Hunt ends up with the girl at her house overnight having sex. A better way to create a Josephine-Juliet doomed romance could not possibly exist. And then she escalates again until winds up with this scenario, where she's going to have to go to jail and they aren't going to be seeing each other or contacting each other.
If you believe that kids are old enough to be having sex, then you damned well better have the belief that they are old enough to handle such relationships with some degree of maturity, and in this case it did not happen.

(13,184 posts)As I minor, I engaged in sex whether I could "consent" or not. And at least one of my partners was 19 when I had sex with her at 16. According to most of the posters in this discussion, I was victimized and she should have been jailed. I find that notion revolting.
I also find all the interest in this case sort of creepily voyeuristic. It was a couple of teenagers having sex. Leave it alone.

(8,303 posts)How did Ms. Hunt get the idea that she could defy a court order? Either she has tremendous psychological problems, or she just didn't take it seriously. Her lawyer and her parents should have conveyed to her that she had to obey the court. Instead, somehow she got the opposite message.
The contacts began very shortly after the order was issued, some of them were explicitly sexual, and they also met in person.
I feel sorry for Ms. Hunt but no one can do this with impunity and it is not in the public interest to let this slide. Also, I have to admit that it makes me view Ms. Hunt as a dangerously reckless person with whom I think a minor should not be associating.

(8,303 posts)A felony.
I finally realized why the latest development in this case bothers me so much. The original uproar over it was somewhat understandable, and these sorts of attachments and unfortunate legal consequences are not that rare.
Love happens, and in teenagers it frequently is overwhelming. But because it's real and intense doesn't mean it's always wise, and I really don't think a 14 year old should be allowed to engage in such a relationship without pretty close parental supervision. So originally I marked it down as one of those things, and although I thought Ms. Hunt's parents were extremely unwise and in fact unethical in handling it the way they did, still there was ample hope that time and some independent supervision would throttle things down. If the two girls were capable of a mature attachment that would always be open to them later, and in the meantime court supervision would provide a degree of protection from excess.
Now? Now this has taken a far more serious bent. Ms. Hunt has to do jail time, and she is going to get a serious sentence out of this, and probably will be placed on the sex offender registry. Her life will never be free from this.
And the younger girl - her life is truly messed up. Too much publicity, her family has been pilloried, and now if she is intensely attracted to the older girl she too must deal with the consequences involved for years to come. This has become an unnecessary tragedy, but I can't blame the younger girl's parents. It would seem that Ms. Hunt was willing to accept no boundaries from anyone, which confirms their original judgment call that this relationship could in fact be dangerous for their daughter.

(8,303 posts)But that's why the age of consent isn't fourteen.
In this case, it seems that Ms. Hunt isn't old enough to handle a sexual relationship with any degree of concern for the other participant, which to me confirms the judgment of the parents of the younger girl.
Edited: Okay, I read the court affidavit that someone else posted, and it is now clear that Hunt is a sexual predator and never loved this kid at all. That's very disturbing. She needs to be in jail and she needs to be on the sex offender registry. Anyone who would behave that way is a very twisted person.

It's now clear that Ms. Hunt created the situation in the first place in order to gain control over the victim. I was puzzled all along about how this situation arose, but the degree of emotional abuse and domination demonstrated in the affidavit explains why.
The "doomed love" scenario allowed Ms. Hunt to separate the victim from the parents and all authority so that she could gain an emotionally controlling position over her. A very sick and desperate game.

(6,342 posts)It looks as though we have an alleged victim who doesn't agree with how things are being handled by the State, her parents or their attorney. She has felt compelled to do what she thought was the only thing to save Kaitlyn from the State and her parents and that was to reach out and let Kaitlyn know this was not her idea or what she wants. I am totally cognizant that she is a minor.
For Chris Taylor to file a notice with those kinds of details in it, I just cannot begin to fathom why that was necessary. The same Notice with general language could have been accomplished and reached the same objective, to revoke her bond. What happened to a statement like "numerous texts and inappropriate language" without details? With today being the first day of school in Indian River County, I can only imagine the chatter at the school. Even if not said directly to the alleged victim, it is going to be discussed behind her back. You can't stop it.
Nonetheless it comes down to we still have a situation of two teenagers who were in school together and involved in a consensual relationship. Yes one that under the current law is a crime, but still consensual. It was brought to an abrupt end and the older "adult" teen faces up to thirty years in prison. The younger teen cannot comprehend the seriousness of the matter because it was something she consented to. Her opinion is ignored by the State, interrogated by the Sheriff's Department, taken to a church that labels being gay a sin, has the Bible thrown at her, all of her thing in her room boxed up and taken from her, is apparently hit by her parents, and clearly yelled at for lying by her father in the presence of Detective Shepherd at the school in a subsequent interview. How could she not be confused, scared and feel as though this is all her fault and no one is listening? She already tried to speak to Kaitlyn's mother Kelley who shut her down. So she turns to the only person who could possible understand in her eyes and a person she clearly does not want to see hurt and that is Kaitlyn. She wants to try to save her and in doing so she just causes the walls to continue to tumble down.
And here we are. Now there are new charges that set us all back even further. The defense of Kaitlyn Hunt will continue until the matter is either resolved or determined in a court of law, not public opinion.

(8,303 posts)This can't be made up, because the prosecutors are quoting electronic messages.
And sexual predators do create the situation in which they dominate the victim and control the victim. Ricky Chavis comes to mind:
http://crime.about.com/od/murder/a/alexandderekking.htm
An extreme case, but good Lord. Ms. Hunt is very clearly using the threat of court punishment as a club over the younger girl. "Fuck you, you're stupid. You're such a messed up person. You snitched on me." Words of love, right?
And without the knowledge that the victim was given an iPod by Ms. Hunt, it may sound that the things in her room being boxed up is just abusive, but that's what you would do if you were trying to sever contact. Yeah, you're going to go through the kid's room and remove the electronics, aren't you?
It's obvious that the defense attorney is completely misrepresenting the situation in the above letter. The victim didn't initiate contact with Ms. Hunt. The victim didn't set this up. Ms. Hunt did.

It is hard to look at the justice system and not think it's just a trivial system of punishment. Some of the least offensive crimes get the harshest sentences, while the most heinous have useful technicalities and seemingly are never enforced against those who have money and connections.
Her life will undoubtedly be ruined, listed as a sex offender for life and probably with a few years in prison. A pity that Kaitlyn doesn't have the same legal immunity as the torturers. Maybe she will get lucky and her girlfriend will still want to be with her when she turns 18.

(10,362 posts)So, my point is that the law should take into account situations like this.

The severity of the offense doesn't seem to matter, it's whether the crime has a technicality or you know someone who can stop prosecution. That's why she will be cast into the same hopeless pit as the creepy rape van guy, Manning will spend 35 years in prison, and torturers will walk free.

simply because I think the prison system is out of control. I think that she should be punished - fines, house arrest, community service, or make her stand on the damn street corner with a sign. I just hate to see non-violent offenders sent to prison - male or female - because I don't believe they are protected from violent inmates.

She was balling in court the other day. I think maybe the situation is finally starting to hit her now.
A few weeks ago, the prosecutor and the judge demanded the defense attorney show proof that she showed the plea deal to Kaitlyn. They wanted a signed statement from Kaitlyn herself that she's declining the deal. (This was before the deal was withdrawn.) I dont think they ever did get that proof.
Her best bet at this point is to start taking this seriously. Stop listening to her parents, fire her attorney, and hire a better one and start asking for some kind of plea deal. If she goes to trial with this attorney, she's going to be looking at a decade.

She's 18-19 years old throughout this thing. She doesn't have a whole lot of experience with the real world yet. So the adults around her are still a big influence. And I dont think they have been a very good influence at all. She's going to have to grow up really fast now.
