Virginia Teabagger stands on highway overpass with automatic weapon, pistol, and Impeach Obama sign

http://wtvr.com/2013/08/27/constitutionalist-carries-assault-rifle-protests-obama/

HOPEWELL, Va. (WTVR) – A local Tea Party member has been protesting perched above busy overpasses, with his assault rifle and semi-automatic handgun in plain sight.

“I was illegally searched, my weapons were illegally taken from me, I was illegally detained. I was publicly humiliated.”

We asked Howard if he escalated the demonstration for publicity. He said “no.”

“If you’re a sworn officer to uphold the law, it might make sense to know the law you’re trying to uphold,” was his retort.

"Why is every-body always pick-ing on me?"

Sometime in the future, someone will misread one of these "protests" and take the doofus out from behind.

and they got ordered off for "safety reasons" or were actually arrested? I do. I'm not arguing with you at all but when I heard this on the radio (the local RW radio host even called this stunt "dumb&quot I remembered all of the instances where no guns were involved and they still were told to "move along".

second - the guy clearly knows the law but he might have the right to do it but it isn't the right thing to do. Most people don't know gun laws THAT well and when they see someone with a gun they call the cops.

I was being sarcastic about the clock tower quip. This clown was a danger to all that passed over or under the overpass. He may have a "right" to stand on an overpass waving a gun, but with such a right comes responsibility. It's not responsible to stand on an overpass waving your gun, lest someone will misread your protest and take you out from behind.

From the article:

<snip>
However, the chief says, and legal experts agree, that there’s a fine line between individual rights and public safety. University of Richmond law professor Jack Preis references Oliver Wendell Holmes, Jr. opinion in Schenck v. United States, often paraphrased as “shouting fire in a crowded theater.”

Holmes ruling addressed the opposition of free speech and “clear and present danger.” Thus, even if citizens have the right to free speech, falsely yelling fire could incite panic and create danger. The ruling was later overturned by a 1969 case that limited the scope of banned speech to that which may incite lawless action.

We're one step closer to bringing back the wild west! Yee Haw!

Doesn't say what the arrest was for. If he had a right to have the gun, then it doesn't seem there was any reason to arrest him.

Exercising the right to free speech - it's for idiots, too.

In the wild west the guns were holstered. These asses carry assault rifles in hand and I would not blame someone for taking someone out, because if their judgment is so impaired to take such a weapon into a public space, then they can't be trusted.
