Breitbart lost a Motion to Dismiss in the Sherrod case on Feb. 15, 2012

That's the Court's Statement of Reasons.

Breitbart tried to dismiss Sherrod's complaint based on a D.C. anti-SLAPP law. The Court denied Breitbart's motion as I read the Statement of Reasons.

Could Breitbart have been depressed at the cost of pursuing his defense?

With the speculation about counter suits by Current TV and the possibility of the discovery process bringing to light all the machinations by Breitbart and O'Keefe.

That could certainly have gotten him a little worked up!

I suppose he could have been walking the dog or getting a little exercise...but that's not the first things that came to my mind.

and had heart problems, his heart probably showed him was boss. He doesn't look like he followed a healthy eating regimen. Odd time to be walking. Perhaps he thought he had heartburn/gas and was trying to walk until the pressure relieved itself.

his co-defendant is colleague, Larry O'Connor .

I doubt the case had anything to do with his death. As a matter of opinion, I believe this kind of case was something that Mr. Breitbart thrived on-- discovery and all.

Breitbart's attorney may have told him to settle. When judges issue statements like that one, it can be a hint to settle. Breitbart struck me as being unyielding and proud in nature. I think he would have had a hard time dealing with the loss of a motion and the kind of remarks the judge made.

is that having someone outside their head hear their whole case and reject it sometimes destroys their delusions. Reality can be rough on a person.

but Occam's Razor would suggest that he had what they call a "widow-maker" heart attack. I had a cousin keel over at about the same age as Breitbart, dead before he hit the ground...
