Term:
The term hereof commence in ________ until the last day of.________
Either shall terminate the same by giving the other party 30 days written notice delivered by certified mail, provided that the Tenant agrees not to terminate prior to the expiration of One (1) month.
I will admit I am stupid I expect to be told so. I just want to know if this means my wife and I can move out early?

As it's written that could be an annual lease that can be broken by either party after only living there for 1 month.
If you want an annual lease that should be spelled out clearly and it shouldn't make any difference to the lessor if you give him 45 days notice so long as you stay there for the term of your lease.

(56,582 posts)After 1 month, you can if you want break the lease, but you have to give the landlord 30 days notice, so that's another month basically.

(3,769 posts)but be careful of the notice required. Many leases require notice 30 days PRIOR to the due date of the NEXT month's rent.
If your rent is due on the 1st of the month and you want to leave anytime in November you need to give notice BEFORE Oct 1. Leaving any time in December? Give notice BEFORE Nov 1 and so on.
Looks like you need to stay at lease one month before giving notice.

Technically you could give notice on the day you move in and leave after the first month.
It's definitely in your favor.

It's possible that what is intended is the lease last for a year, but is trying to clarify the 30 day notice to terminate.
I'm not an attorney, nor am I terribly savvy about leases (others here do seem to know much more) but I'd like to see you attempt to clarify what is actually meant, and then having that paragraph re-written so it is in clear language.

Not having that section completed, I cannot tell if it is a month to month lease, or what. Different states have different rules governing month to month leases versus longer term leases.
Secondly, take notice ... the second term allows you to terminate the lease with 30 days notice; but it also allows the landlord to terminate with the same notice.
If you have other options, I would look else where ... it appears to be a cobbled together lease by someone that either doesn't know much about contracts, or worst, wants to be able to break the lease for whatever reason.
