If she does, he will claim she is just after money and really doesn't care about principles. Then the focus shifts from his vile comments to her motivation. That will muddy the argument some even if none of his claims are true.
IMHO she should stay out of court for now and keep speaking out! Fluke has a good bully pulpit that would get lost in legal proceedings.
She should definitely get some legal advice and keep an eye on the statute of limitations.

(11,065 posts)This is PERSONAL for her. She's not a poster child to be used for anyone else's agenda. She should be recognized as an individual grieviously wronged and be supported in whatever SHE decides is best for HER to do or not do.

(42,740 posts)First, it would undermine the argument that she suffered any actual damages for which she needs to be compensated, since she's announced she is giving away any damage award.
Second, and more significantly, imo, she greatly increases the risk of alienating at least one juror which could kill her case. One juror who is not a fan of planned parenthood and her case is toast.
I've posted elsewhere in detail what bringing a defamation action would entail for Ms. Fluke. I cannot rule out the possibility that she could win, but there are substantial risks that I would expect she will fully consider in making the decision.

(11,101 posts)It's easy for you to say "don't make it about the money". Well maybe she could use the money. If she's been harmed and can legally collect damages I have a hard time telling her or anyone else that they should put that aside for what the rest of us think is the more noble path. The noble path is rarely accepted in lieu of rent. Besides that, although I agree that the college dropout disk-jockey would attack her for wanting his money, if you think about it, the attack makes no sense. What, did she plot to somehow get invited to speak and then plant her name in Limbaugh's show prep in order to trick him into slandering her so she could grab all his cash? I'm not saying she should sue or shouldn't, but it's her call.

(1,665 posts)Soon she will be going out into the world and seeking a law firm to hire her. Rush may have done irreparable harm to her professional status. Most employers now do google searches on prospects and it is entirely possible that she wont be hired at some firms because of his lies. She has every right to sue and sue big over his liesand it doesnt matter what she does with any compensation she will be awarded
