Sober driver arrested for OWI when deputy crashes into her car

OK, not just arrested. Badly injured, and blamed. This story blew me the fuck away.


At the age of 25, Weyker’s criminal history is as flawless as her posture. She was diagnosed with cancer at age three, and the prolonged radiation treatments literally curved her spine. So doctors inserted metal rods to keep her back straight. The lifelong medical complications have not stopped her from pursuing a college degree. Or from driving a car. In fact, Weyker had never gotten so much as a speeding ticket until the night she crossed paths with Milwaukee County Deputy Sheriff Joseph Quiles.
It was February 20th, 2013, and Deputy Quiles was working the night shift on patrol at General Mitchell International Airport. As he pulled out onto Howell Avenue to make his rounds, he T-boned a passing car and sent it spinning into a tree.

Her spine was already fused with steel. Now, she had a fractured neck to go with it.

Her injuries were too severe to allow for any field sobriety tests. She couldn’t even give a breath sample. But another deputy, who also worked in the airport bureau, arrested Weyker anyway, on five separate charges including drunk driving causing injury.

The truth might never have surfaced were it not for video from a nearby airport surveillance camera. It shows what investigators say is Deputy Quiles’ squad car traveling west on Hutsteiner Avenue, then continuing onto Howell without making a complete stop, as Quiles claimed in his report. The Sheriff’s Office knew about the video just two days after the crash. But no one told Weyker.

Instead, the County sent letters blaming her for the crash and threatening legal action if she didn’t pay for the damage.

Stories like this really need to be seen. And if enough of them are seen, maybe - just maybe - things will change.

In the meantime, I hope the poor girl gets a great lawyer and is awarded millions of dollars from the Sheriff's Office. Sure, that will be taxpayer money. Maybe that will motivate the taxpayers to demand the sheriff's resignation and the deputy's arrest.

It would be very interesting to find out how much personal involvement Sheriff David Clarke has with the handling of this case. He is a right-wing guy with some serious personality issues who runs as a Democrat because that's the only way he can get elected in Milwaukee County. (The Democratic Party disavows him strongly but can't legally stop him.) He is up for reelection in November (but effectively in the August primary) and has a serious challenger, Lt. Chris Moews, who made a good showing last time. Meanwhile Clarke has indicated that he may run for mayor!

The Decline of Sheriff Clarke
But in the last year or two, Clarke seems to have gone off the deep end. Perhaps nothing is more illustrative than this Journal Sentinel headline in February: “David Clarke accuses Chris Abele of ‘penis envy’ in latest rant.”

The comment merely made Clarke look childish. And since County Executive Abele isn’t really seen as a liberal (county board members have called him “Scott Walker lite”), Clarke’s feud doesn’t play to his classic storyline, that he’s smiting those silly liberals. Perhaps worst of all, the headline dubbing this Clarke’s “latest rant” helps cement an image of him as a crackpot.

In particular, JS columnist Dan Bice is having a field day covering Clarke, with several columns noting the public money the Sheriff is spending on ads telling people to arm themselves or handle intruders by being “ruthless,” and a column about Clarke’s agreement with a crazed conservative who believes the federal government is a greater threat than terrorists.

Clarke is now accusing the Journal Sentinel of suffering from “Clarke Derangement Syndrome.” Bad move. You never pick a fight with the state’s largest newspaper, it will only hurt you. A narrative is beginning to set in, that Clarke is losing credibility in the community, as this op ed in the Biz Times suggests.

Besides Abele, Clarke has picked fights with county board members, Mayor Tom Barrett, Police Chief Ed Flynn and various other officials. Meanwhile, Clarke is taking weird stands that leave him as an island unto himself. The legislature’s proposal to bring back private bail was opposed by everyone in the criminal justice system, including the Wisconsin District Attorneys Association, Wisconsin Association of Criminal Defense Attorneys, all 47 Milwaukee County judges and all 10 of the state’s chief circuit judges, not to mention the Wisconsin Sheriffs and Deputy Sheriffs Association, police chiefs and clerks of court. Only Clarke has publicly favored it.

And what exactly is the record Clarke has to run on for reelection in 2014? His opponents can note his department does little to combat serious crime, handling just one-fifth of one percent of all major property and violent crimes in the county, as I’ve reported.

One of my favorites is when he decided to change the sheriff's emblem from a 7-pointed star to a 5-pointed one (reputedly matching his tatoo). That meant changing all the badges, stationery, squad car logos, and so on. How much taxpayer money was spent on this whim? He is a darling of the Tea Party, but not for fiscal responsibility.

Need to be further criminalized, and the maximum sentence needs to be the same as the crime being prosecuted, including enhancements, "three strikes" penalties, and the like.
There are some bad cops out there - and a lot more willing to cover up for them. In this case, there are some "suits" that need to go away for a while, and have their lives ruined, as they have so casually ruined lives.

And I'd add that the sentence for malicious prosecution, false arrest, or falsifying, destroying, or "misplacing" exonerating evidence should be the same as the maximum for whatever crime the innocent person was being railroaded on. That's about the only way we'll see this bullshit stop is to let them have a taste of the zero tolerance they're so fond of.

A county officer made a left turn on a red light and plowed into me. His first reaction was HE had the green light. Fortunately a witness differed with him and a city officer came and wrote him a 'failed to yield the right of way' ticket.

My vehicle was totaled.

Fortunately my wife, who was 8 months pregnant at the time, chose not to go out that night. If she'd been with me, who knows what would have happened.

Deputy Quiles has not worked in more than a year since the crash. He has exhausted his injury pay and has now filed for permanent duty disability for injuries he suffered in the crash he caused. His application is still pending before the County’s Employee Retirement System.

One in seven Ohioans has one – a life-long legal scar that has become the voodoo of our generation(s). According to the Ohio Department of Safety, more than 1.3 million licensed drivers in the state have at least one “DUI” conviction. This eye-opening number suggests far too many Ohioans are getting behind the wheel impaired.

But percolating through appeals courts across the state is a growing number of defendants who believe they limited their blood alcohol to a safe level. They’re challenging the state’s certified breathalyzer, the Intoxilyzer 8000, claiming it wrongly inflated their blood alcohol level or BAC.

Defense attorneys across the state say the Intoxilyzer 8000 is fundamentally flawed because its main function is based on bad science.

Several judges subsequently ruled in the defendants favor, calling the breathalyzer “unreliable,” which makes the line between illegally impaired and legally able to drive in Ohio (.08 of BAC) not so clear anymore.

Drinking one or two beers can’t possibly get anyone arrested, but the Intoxilyzer 8000 cannot differentiate the breath from your lungs than from your mouth, where there’s a much higher concentration of alcohol. Thus the time a person takes to finish a drink and get behind wheel becomes a significant factor in whether “You just blew $10,000,” as the anti-OVI billboards state.

Almost every time one of their sheriff deputies blows a red light and crashes into someone, they will claim that person was DUI/DWI and arrest them.

"No, Mr. Prosecutor. I'm at 125 Fake street. Here's my ID."
"Ok. The shooting is justified."

They all cover each other. It's very rare to see a cop actually jailed for crimes they commit. The guy that killed Oscar Grant was released after just 16 months. If I shot and killed someone accidently, there would be no way I'd get out in less than 5 years.

the news stories that we all see and either get outaged at the behavior of the police, in which case they shouldn't have a problem with defending ourselves against illegal acts, or they agree with the acts, in which case they are part of the problem. Cops shooting dogs and innocent people. Either they stop on their own, or they are forced to. Make them wear body cams. Stop arresting people for filming police. And if a cop get shot and killed doing an illegal entry on a no-knock raid, it's not exactly a tragety.

innocent until proven guilty. You have no hope of proving this lady with no track record of bad behavior was behaving badly on the night in question. The burden of proof is on you pig-fuckers, not an innocent citizen you try to blame-shift your own bad behavior onto. Straighten up cops! We're getting tired of you thuggish, lawbreaking ways.

Many Russian drivers have operating dash cams so there will be some evidence to support their version of events if they are in an accident.

but I can see that they are a dying breed I think.

If they aren't shooting dogs for no legit reason (and one just got caught abusing his own k9), they are beating up homeless people (some to death), roughing people up when they are being compliant, shooting and killing people when there was no earthly reason to do so or arresting an innocent woman of drunk driving when the cop made the mistake.

I mean what the hell is this? She couldn't do any sobriety tests at the scene so it was assumed she was intoxicated, just because it was an accident with the cop? Who's to say she was drunk anyway, could have been a mistake but he's just presumed innocent and assume DUI? That's fucked up. Everybody makes mistakes, even the cops can make a traffic mistake.

Just unreal.
