Jackson Clarion-Ledger today: Fed hearing set for runoff; McDaniel wants new ruling

A federal judge has scheduled a Thursday hearing for arguments in Texas-based True The Vote's lawsuit over voter records from the June 24 GOP primary runoff.

Meanwhile Chris McDaniel continues to gather information for a challenge of his loss to incumbent U.S. Sen. Thad Cochran in the runoff. McDaniel has asked the state Supreme Court to reconsider its rejection of his request for access to poll books without voters' birthdates blacked out, in part to avoid the expense of paying to have the records redacted.


In the state Supreme Court appeal, McDaniel lawyers say they need to see birthdates in poll books to identify voters with the same or similar names, and the cost of redacting the records is prohibitive and unjust. But the court ruled Thursday that poll books are public records maintained by circuit clerks and therefore subject to the state Public Records Act, which requires redaction of personal information such as date of birth before being made public.

In an interview Friday on "Focal Point," a talk-show on American Family Radio in Tupelo, McDaniel criticized Cochran's campaign and political action committees that supported the incumbent.

"They hired Democratic operatives to go out into Democratic communities and call me a racist," McDaniel told host Bryan Fischer. "That's despicable. It's the scarlet letter that they know works in society. It's the way Democrats campaign. It's the way liberals campaign."

...Mr. McDaniel still has offered no evidence to back up his claims. His spokesman, Noel Fritsch, told us that the delay was “to make certain that we have our ducks all in a row.” Mr. McDaniel has now embarked on what he calls a Truth and Justice bus tour to rally supporters around the state. His campaign Web site states plainly: “Democrats steal the Mississippi runoff.”

The close election displays in full light the ongoing push-and-pull between the tea party and establishment Republicans. It also reveals the tea party’s troubling alienation of minorities — a key reason Republicans can win district seats but have difficulty in national elections.

But Mr. McDaniel’s challenge of the election’s legitimacy isn’t just a party problem. In even the closest primaries, such as Tuesday’s narrow GOP election in Georgia, the loser typically concedes in a bid for unity. Since elections inevitably have a few voter irregularities caused by human mistakes, the burden of proof to challenge an election is high — as it should be.


And Roll Call reports today:

The campaign owes $100,100 in debt to McDaniel, who loaned that money to his campaign at the end of last year. Some of the money left over in his campaign account likely could only be used in the general.

McDaniel’s campaign is still raising money, but all of it is going toward the legal fund, which is being used to finance the examination of election records and to pay attorneys. McDaniel spokesman Noel Fritsch estimated a challenge would cost hundreds of thousands of dollars and that the campaign had already spent around $100,000 on lawyers.
