That they are never really finalized because there is always the next challenge and some court - be it SCOTUS or some Federal Appeals court - takes it upon themselves to make another ruling on.
Things keep ping ponging back and forth depending upon who is in the majority and things are never finalized. Something Clinton did as a President can be undone by Bush something Bush did can be undone by Obama and something Obama did can be undone by the next administration, etc, etc, etc.
We never really put an issue to bed and finalize it and move on. Roe vs Wade is still being kicked around as another example.
Then one wonders why the American People are disgusted with the process?

I've written numerous posts here warning the LGTB community here, and elsewhere, NOT to become complacent because the issue appears to be settled. It never is. I hope they learn from us women, especially us right-to-choose activists, because we, too, thought Roe v Wade was settled law. Some of the bad guys even said as much, in the past, to soothe and disarm wary voters in earlier elections - Trojan Horse candidates who'd tell you what they thought you wanted to hear, with no intention WHATSOEVER of standing by their promises if they ever got into office. And the proof remains - as soon as they get in, they don't want to bother about jobs and the economy anymore. They go straight up our vaginas.
