When a University of Oregon (UO) rape survivor sued the school earlier this year for bungling her case, campus officials used the student's confidential therapy records in order to counter her claim. Frighteningly enough, this total invasion of privacy is legal.
Sign the petition from Daily Kos and UltraViolet, telling Congress: Don't let lawyers use rape survivors therapy records. Close the consent loophole in the Family Educational Rights and Privacy Act (FERPA).
Unbelievably, a loophole in the Family Educational Rights and Privacy Act (FERPA) gave UO a right to the students medical records.
In fact, the records of students seeking counseling at their colleges counseling centers are not protected for privacy purposes like other medical records are, meaning that an educational institution can use a students trauma to re-victimize them.
