Man arrested for DWI again minutes after DWI conviction
Erie County sheriffs deputies say J.B. Silverthorn was in court for an arrest in December after driving into the Niagara River while drunk. Silverthorn drove into the Niagara River on December 29 and was stranded three feet deep in quickly moving water. Police towed him out with a boat.
Silverthorn was found guilty Monday night for drinking and driving. But police say people around Silverthorn noticed he smelled like alcohol, and the judge who found him guilty and his attorney representing him asked him not to drive home that night.
Police say he was also stopped in the hallway by officers who noticed his intoxication and they told him not to drive home.
Police say he left the courthouse, got in his car and soon after attempted to drive home, but police were watching. He was stopped as he pulled out of the courthouse onto Grand Island Boulevard.
Police charged Silverthorn with felony DWI having just that night been convicted of his first DWI and driving with no headlights.

(3,937 posts)Sad that the guy has a severe problem and the lack of effective treatment for it puts others at risk.
Also sad that the only "help" that law enforcement can provide is warnings, punishments and fines. He should not have been allowed to drive after all of them knew how drunk he was. If a bar had let him drive the bar would liable.
Literally treating the symptoms and not the disease.

(37,452 posts)the vehicle. The warnings were sufficient and the defendant chose to ignore them. When they were given he was not in his vehicle. He must have thought they wouldn't watch him. In NY state all the fines now go towards DWI enforcement programs. Treatment the state offers programs. There is a 22% recidivism rate in NYS and apparently the defendant is one of those in that category. He isn't the first and won't be the last. He just doubled down and its going to be very expensive.

(2,931 posts)But in California you can be arrested for a DUI without driving. There was a case were a guy was drunk, wanted to do the right thing and sleep it off in his car. He put his keys in the trunk of the car and passed out in the drivers seat in the parking lot of the bar, and got a DUI.
A different case was when a guy had his keys in his pocket and was walking to the parking lot (likely to drive home) and was arrested for a DUI before he got to the car.

(1,241 posts)got drunk BEFORE his court appearance for a DUI. The judge and everyone in the court room smelled him. He reeked in the elevator. Needless to say, straight to jail. He has been sober about 3 years now. Not his choice but he is starting to like sober I think.
