Ammon And Ryan Bundy Denied Bail

A judge at the federal courthouse in Portland Friday denied bail to three of the militants arrested near Burns earlier this week in connection with the armed occupation at the Malheur National Wildlife Refuge.

Judge Stacie Beckerman denied bail to both Ammon and Ryan Bundy, saying both defendants are a flight risk and a danger to the community. Beckerman also denied bail for Ryan Payne.

The judge granted bail to a fourth defendant, Joseph O’Shaughnessy, however federal prosecutors appealed the decision. As a result, a ruling on O’Shaughnessy’s release has been stayed until Tuesday.

The remaining six defendants stayed to have their detention hearings when the court took a break Friday afternoon ...

Two criminal complaints unsealed this week against the 11 protesters under arrest show that FBI agents have carefully scrutinized social media postings, interviews and online talk shows that were broadcast from the Malheur National Wildlife Refuge during the siege that began nearly a month ago ...

A day after the takeover began, for example, a video posted on a website showed Bundy saying the group planned to stay for several years. He called on people to "come out here and stand," adding: "We need you to bring your arms."

A video posted Jan. 4 showed another defendant, Jon Ritzheimer, saying he was "100 per cent willing to lay my life down" ...

The last holdouts in the Malheur National Wildlife Refuge standoff say they now want pardons for everyone involved before they'll leave the headquarters where they're holed up behind police roadblocks.

"Before we leave, every single one of the people involved in this operation should be pardoned," occupier David Fry said in a feed posted to YouTube just before noon Friday.

... The motion, filed by U.S. Attorney for Oregon Billy Williams, says Bundy and his followers pose flight risks, lack ties to Oregon, and aren't likely to comply with pretrial supervision because they don't believe the federal government has any legal authority over them.

Williams also argued the Bundys are likely to try to take over the Malheur National Wildlife Refuge again ...

Among the most interesting revelations in the motion filed by prosecutors: Ryan Payne, the security chief at the Malheur occupation, explained himself to FBI agents after his Tuesday arrest.

If they are bailed they would almost certainly go underground. They would disappear into the prepper/rural background, some fellow lunatics would give them their hunting cabin or such to live in, provide sustenance and cover.

The Constitution prohibits excessive bail.

I suppose they could make that argument?

The laws are made for all of us, including militiamen...

no absolute right to bail in every case: defendants may be detained without bail for various reasons, including the likelihood they will not appear for trial or the possibility they will do further mischief on release
