(12,157 posts)I don't the the chief has a 1.1 vote. A tie is a tie. If someone else has a better answer I would like to read it.

(2,493 posts)Means the ruling from the lower court stands but the SC decision is not binding precedent. Issue could be reconsidered by the SC in the future but in the meantime courts in other Federal Circuits can rule however they want on an issue

she was Solicitor General.
Note that right now there are only 8 justices as Justice Scalia died this past week.
