Interesting Supreme Court History

I teach government, and I love researching Federalist papers and documents on the founding fathers. In light of Justice Scalia's death, I did some research. John Adams lost the election of 1800 to Thomas Jefferson. On January 20, 1801, the still then President, John Adams nominated John Marshall to the Supreme Court and the Senate confirmed him on January 27,1801. Adams lost the election and was still able to nominate a Justice and get him confirmed without any complaint or issue. The founding fathers would be fine with President Obama nominating a Supreme Court Justice today. And the Senate confirmed justices without questions and we have the confirmation process now only due to TV.
