Facing federal gun charges, 'embedded' reporter at Oregon standoff seeks release

Michael R. Emry, who described himself as an "embedded journalist'' during the standoff at the Malheur National Wildlife Refuge, is asking a judge to release him as he awaits trial on federal weapons charges in Oregon.

His attorney Mark Sabitt on Friday filed a motion to release Emry from custody, noting that Emry's wife has relocated their fifth-wheel trailer from Grant County to Cresent in Klamath County, at least 150 miles away from an informant who prosecutors say feels threatened by Emry ...

Emry was arrested in John Day in early May after FBI agents found a machine gun – identified as a fully automatic .50-caliber Ma Deuce Browning M2 – in a travel trailer serving as his home, according to federal prosecutors and court papers.

Emry acknowledged that he stole it from a Boise dealer where he had worked and ground off the serial numbers, according to a federal prosecutor. An informant told authorities about Emry's plan to take the .50-caliber gun, which Assistant U.S. Attorney Nathan Lichvarcik has described as a "weapon of war,'' to the Malheur National Wildlife Refuge during its occupation this winter ...

Michael Emry admitted that he stole a fully automatic .50-caliber weapon, ground off the serial numbers (I wonder why he would do that?) and transported it as a "weapon of war." Mr. Emry was also overheard making a not-so-veiled threatening statement about a confidential witness. And he and his lawyer think he should be released from custody.

I hope the judge keeps his ass in jail.

instead of 25 years for which he is eligible. After all, he was performing a pubic service by keeping us informed about the events.

JOHN DAY – Michael R. Emry figured out on his own how to build a potent bomb that a major drug dealer needed to kill an associate.

..... "Lord forbid I ever have to pull a gun on a law enforcement officer," he said, but "I may have to if they start breaking the Constitution and the oaths that they upheld." ....

Emry didn't specify during the trial the source of his unhappiness with the government. He testified that he was a transmission repairman by trade, working at one time in Kansas. He said he built machine guns for a customer there who was stockpiling weapons in the event of civil revolt.

This self-taught bomb maker made 66 illegal machine guns for one person according to his own testimony. He's not going anywhere except to a high security lockup.

.... I have a natural aptitude for this stuff," Emry testified .... he said he was known as the "Picasso of machine guns."

We should amend this law so that rifles that semi auto rifles and short guns would be treated just like 50cal Fully Auto rifle.
