A Vandergrift (PA) man who police said showed interest in vampire-like cults will serve 10 years on probation and two years of house arrest for having sex with a 14-year-old girl last year.
Jonathan Ryan Davis, 22, pleaded guilty in November to a felony charge of statutory sexual assault in connection with an encounter he had with the girl in a church stairwell after they had been drinking alcohol.
Westmoreland County (PA) Judge Richard E. McCormick Jr. said:
At this point, the court is satisfied this sentence will meet the requirement of punishment, rehabilitation and the protection of the community
Assistant District Attorney Chris Flanigan lobbied for a prison sentence that required Davis to serve more than two years behind bars.
... Davis had (previously) been convicted in juvenile court for impregnating a 12-year-old girl ...
Davis told the judge he was remorseful for his actions.

(6,342 posts)Sometimes a juvenile conviction gets wiped from the record completely. Meaning the judge in this case might not have been allowed to consider that, depending on the laws in that state.
The article doesn't give much information concerning that case or when it happened. But he was obviously a minor at that time.

(44,973 posts)to argue he shouldn't just get probation in this case. Sure doesn't sound that his juvenile conviction was wiped, or judge wasn't allowed to consider it.

(44,973 posts)One would think that considering a previous offence, something more than just probation is warranted.

(4,035 posts)There, I fixed the headline for you (or more correctly, for the shithead journalist.)
You cannot have sex with a 14-year old girl, or boy, for that matter, (unless you're covered by Romeo and Juliet laws) you can only rape them.
