The documents released today weren't any of Secretary Clinton's e-mails. The documents were from the FBI investigation. Oddly enough, a person usually has to get a court order to get the FBI to release anything, and if there's not a criminal referral, it's even less likely that a court would order the FBI to release its internal investigation documents.

But for some reason, the FBI has been holding press conferences, releasing its internal documents, and providing a step-by-step explanation for why it didn't make a criminal referral of the matter to the Department of Justice. This disclosure by the FBI may be unprecedented; usually, the FBI doesn't even acknowledge that they're conducting a criminal investigation unless and until they make a referral to DOJ for prosecution.
