The judge ruled there is enough evidence for a trial. I believe her, not because of what she said, but because he has shown us a pattern of behavior.

This is simply incorrect. The court set the initial status conference automatically with the filing of the complaint. The court has made no ruling on the complaint or whether plaintiff can state a cause of action.

The complaint was filed on September 30. On October 4 the court issued its order setting the initial status conference. On October 12 the court issued the summons. At this point it does not look like Trump has even been served. Once he is served, he will have 21 days to answer or otherwise respond. He could seek to dismiss the claim at which time the court may make a ruling regarding the complaint. However, at this time all we have is the complaint.
