Kevin Turner had CTE, not ALS

As the U.S. Supreme Court considers whether to take up the appeal arising from the failed challenge to the concussion settlement, a medical development could give the legal process a boost.

The Boston University Brain CTE Center announced on Thursday that former NFL fullback Kevin Turner, who had been diagnosed with ALS, actually had Chronic Traumatic Encephalopathy.

Via Daniel Kaplan of SportsBusiness Journal, lawyer Deepak Gupta calls the news a “bombshell” that “thoroughly undercuts what little legitimacy the settlement had.”

The proposed settlement provides compensation to players who have a variety of “qualifying” conditions, including ALS. Players can’t be compensated for simply having CTE during their lifetimes, and as Gupta characterizes it only players who died with CTE before the settlement approved are eligible for compensation. (That’s apparently accurate; prior reports indicate that an April 15, 2015 deadline for compensation for death with CTE was created in order to not give players who believe they have CTE but who didn’t have a “qualifying diagnosis” an incentive to commit suicide.)
