Keep in mind that regulators are the executive branch's implementation of laws passed by Congress... They aren't an exclusively executive function.

What the Congressional Review Act does is delay implementation of new regulations for 60 days so that Congress can take a look at them (and theoretically check to make sure that they are consistent with the law they wrote). They have that time to vote to undo the regulation (by majority of both houses)... But the President can veto it.

So you hardly ever see it happen because the President could just veto the block... Except that he has less than 60 days left in office. So what they're saying is that they intend to override anything he does right after he's gone, because they know that Trump isn't going to give them.

Even though CRA is immune to filibuster, it still eats a lot of floor time, making it hard for even a determined majority like this to make a huge impact. Senate Democrats have very little incentive to go along with this scheme, it would only give them more time to cause mischief.

Additionally, it allows them to block things that would be politically damaging to oppose individually.

My point though, was that this isn't some violation of separation of powers or otherwise an illicit power grab. Congress definitely has a role to play in evaluating regulations that implement their own legislation.

They don't have to send it up for signature until after he's gone...And new regulations generally can't be published until after a 60 day wait.
