LINCOLN Opponents say the housing restrictions contained in a Fremont, Neb., illegal immigration ordinance are likely to be struck down in light of Mondays U.S. Supreme Court ruling on a similar Arizona law.
Supporters of the ordinance, however, say they remain hopeful the measure will survive in part or whole.
The Arizona decision will influence how the 8th U.S. Circuit Court of Appeals rules on the Fremont ordinance in a pending appeal. Lawyers on both sides are preparing legal briefs on the appeal, which is expected to be argued this fall, with a decision not expected until next year.
The Fremont ordinance bars employers from hiring illegal immigrants and prohibits landlords from renting housing to them. The housing provisions were placed on hold during an appeal of a ruling by U.S. District Judge Laurie Smith Camp in February. Camp threw out provisions calling for landlords to evict illegal immigrants, saying they ran counter to federal immigration policy.
