A Republican state senator facing felony child prostitution charges after police say he solicited sex from a 17-year-old boy plans to resign from his seat, his attorney said late Monday.

Attorney Ed Blau said he'd recently been retained by Sen. Ralph Shortey and that it was premature to comment on the charges until he had more time to discuss the case with his client.

"Other than the probable cause affidavit that was released publicly, I haven't seen a single police report or talked to a single witness," Blau said.

Blau said he expects a not-guilty plea will be entered on Shortey's behalf when he makes his initial appearance in court later this week. The attorney also said Shortey intends to resign by Wednesday evening.

OKLAHOMA CITY - An Oklahoma immigration attorney has announced he's running for a state Senate seat that is likely to become vacant Wednesday when state Sen. Ralph Shortey resigns.

Michael Brooks-Jimenez, a Democrat, ran against Shortey in 2014 but only garnered about 42 percent of the vote. No one else has announced their intention to succeed Shortey, who is facing three felony prostitution charges after police found him in a hotel room with a 17-year-old.

OKLAHOMA CITY -- Raised on Oklahoma City’s southside, Michael Brooks-Jimenez – running as a Democrat in Senate District 44 - caught the political bug at an early age, as he recalled recently at his law offices on S. Western Avenue.

It was around the age of 10 that Brooks-Jimenez, now 44, helped out on Democrat Keith Leftwich’s first campaign and later worked as a page for Leftwich, who was a strong voice for Oklahoma City’s southside.

“I would see him at various events,” said Brooks-Jimenez in an office decorated with colorful, framed rock band posters featuring everyone from Bunny Wailer to Dave Alvin to X. “He was always there and knew everyone.”

In the intervening years, however, that strong leadership has been harder to find, he said, as the older generation retires or passes away. Keith Leftwich died of cancer in 2003.

Vacancies

How vacancies are filled in state legislatures

If there is a vacancy in the senate, the Governor must call for a special election no later than 30 days after the vacancy happened. No special election can be called if the vacancy happens after March 1st during the year the seat is set to expire.

The only exception to the March 1st deadline is for Senators who resign with two or more years left in their term during an election year. If the resignation was announced before June 1st and the effective date is scheduled for after the general election, a special election can be called.

The person who wins the special election serves for the remainder of the unexpired term.
