(17,863 posts)What if he stayed and died? Would Gorusch then claim that the employer did act with his employee's safety in mind because any reasonable person would unhook the trailer and drive away. It would have been the driver's fault that he died.

(20,192 posts)and caused an accident, the trucking company would have been sued. By doing what he did, he saved himself AND his employer. And for that he was fired and Gorsuch thinks that's a okay!

If he had frozen to death the Trucking company would have been sued by the Trucker's next of kin.
The only scenario where everyone emerges whole is the one the Trucker chose.

however, i do surmise that this post has to do with the gorsuch hearing.

(6,251 posts)Senator Franken went to the heart of the situation, asking Gorsuch what he would do personally if he were in the cab of that truck, in minus 14 degree weather. Would he stay with the truck and die of hypothermia, or would he take the trailer with the frozen brakes out on the interstate, driving at 10 to 15 miles per hour among other vehicles going 70?
Gorsuch had no answer but word salad.
