Also there was functionally nothing stopping ISPs from doing this previously. All they had to do was put it in the fine print nobody ever reads and presto, you agreed to it. The FTC under Wheeler had attempted to make this opt in, but that was never implemented.
Additionally ISPs are pushing to have a man in the middle process that would allow them to access encrypted traffic.
The better solution is to enact strict privacy laws, not rely work around solutions that can be counteracted.
