(17,914 posts)pardons for anyone who could testify against him? In today's political climate he might be able to pull it off.
The other side of pardon is that you can no longer refuse to testify to Congress. You can still be in jeopardy of perjury (that is until the President issues another pardon).
Perhaps Trump could give an indulgence for all past and future sins ala the Catholic church in the Middle Ages. I still think Ford's pardon of Nixon was B.S. Pardon should only apply after you have been convicted of a crime. Since it can apply to any crime based on the decision for Ford - why not future crimes as well.

(6,324 posts)As a retired Servicemember receiving retired pay he is still subject to the UCMJ as well as civilian law- nail him in both jurisdictions!

(17,347 posts)He can't be tried in a civilian court and a military court for the same thing as double jeopardy applies. I believe they could pull his retirement pay if he is convicted in a civilian court.

(6,324 posts)The actual charges would be violations of different laws resulting from the same acts anyway, however it has long been held that. Person can be charged in both systems.
DUI is a classic example, the military will allow civilian courts to work their way through and then also charge the individual under the UCMJ. There have been cases up to abdnincluding murder where a person was tried in a civilian court and then the military stepped in and also charged under the UCMJ.

(257 posts)Lying to a government agency is a crime punishable by up to 5 years in prison under the above referenced Federal statute. This is the same statute under which Martha Stewart went to jail. Scooter Libby was convicted under this statute (subsequently his sentence was commuted by George W). The point is that this a serious problem for Flynn, quite apart from all the other charges he may face.
