If trump has been asked to hand over the tapes and now says he has none, I would think he could be

charged with destroying evidence.
Fact is, he said there were tapes for Comey to be afraid of.

he would just argue that he said "he BETTER HOPE there arent tapes". not that there were tapes.

There are certainly other things to get him for, but this made up mud puddle that HE created is not one.
