Authorities on Tuesday released graphic dashcam footage of officer Jeronimo Yanez firing seven shots into Philando Castile's car last year, killing him as viewers watched the aftermath on Facebook Live.
The video and other data collected in the investigation was released following Yanez's acquittal last Friday in the July 6 killing that thrust Minnesota into the national debate over police use of force and racial profiling.
The video released by the Minnesota Bureau of Criminal Apprehension (BCA) and Ramsey County Attorney's office starts about 9:05 p.m. as Yanez activates his squad lights to pull Castile over on Larpenteur Avenue near Fry Street in Falcon Heights for a nonworking brake light, and to see if he is the suspect in an armed robbery from four days earlier. Radio traffic said Yanez pulled over Castile because of they "just look like people that were involved in a robbery" because of Castile's "wide set nose."
The routine traffic stop turns deadly in about a minute. Yanez said he shot Castile seven times because he believed Castile was reaching for a firearm that he told the officer he had. In an interview with the BCA, Yanez said he assumed Castile would be reckless because he smelled marijuana.

(6,324 posts)Castille didn't do things perfectly from the standpoint of what a CCW holder should do when pulled over, but I didn't see anything that should have given the officer any reason to shoot.
The officer shouldn't have said "don't pull it out" if his hands were going for his pockets. He should have commanded him to raise his hands.
"Raise your hands " is a positive command that leaves no room for ambiguity. It's clear and unambiguous.
"Don't pull it out" leaves room for him to still be reaching down to get a wallet or license and the person things he is following commands because he isn't going for the gun, but it looks like it to the officer. It's a bad command and reflects bad training and caused enough confusion to turn this situation bad.
As a CCW holder Castile should have notified the officer he was carrying first and from that point on not made any moves unless instructed to by the officer. That avoids any opportunity for anything you do to be mistaken for a hostile move, and is what I teach in my classes. But his mistakes were minor and while they may have contributed to the outcome it's only because the officer badly botched the encounter, it never should have happened regardless of Castilles movements there.

None of this will change as long as the criminal justice system sees black folks as less than deserving of basic human rights....

(22,443 posts)Almost immediately, the jury in the trial of officer Jeronimo Yanez was leaning toward a not-guilty verdict an all counts.
The vote was 10-2, and after nearly 30 hours of deliberation, the two holdouts werent budging, said juror Dennis Ploussard.
Lots of opinions were shared, but in the end they were able to sway the two remaining no votes when breaking down the legal definition of the charges. He said they focused on the culpable negligence required for a conviction on the manslaughter charge.
Ultimately, Ploussard said, the prosecution didnt prove beyond a reasonable doubt that Yanez was guilty in the shooting death of Philando Castile...There were two black jurors, but Ploussard said they were not the two voting against acquittal. He declined to identify the two holdouts, who changed their minds Friday afternoon.

Fathers Day weekend was a grim occasion to remind black parents that they are continuously hunted down by police in the United States. The weekend was bracketed by two stories of black adults killed by police in front of young, black children.
Before our timelines began to be filled with pictures of smiling dads over the weekend, black folks across the nation were accosted by news that Minnesota police officer Jeronimo Yanez was acquitted in the shooting death of Philando Castile. Castile, who had been stopped at least 46 times by police in his short 32 years on this Earth, was shot in front his girlfriend and her four-year-old daughter the entire tragedy being streamed on Facebook Live...

And not 48 hours later, news began to come out that an equally cruel police killing had happened: Charleena Lyles called Seattle police because of an attempted burglary. According to the police, they found her wielding a knife and shot her dead. Outrageously, Seattle police said: There were several children inside the apartment at the time of the shooting, but they were not injured. Those children who family say were ages 11, four and one were not injured, except for the small matter that they watched police kill their mother.
The particulars of how the police justified the killing of Philando Castile and Charleena Lyles are not important. Like Lyles, Castile was killed for a reason his mother summed up a while ago: he was black in the wrong time and place...

(83 posts)I can't see what Castile was doing with his hands, and I can't know exactly what Yanez saw, but from what I can imply based on the lack of obvious movement of the car and the lack of motion in the car or sound coming from the car picked up by the officer's mic it seems like the officer REALLY jumped the gun here and probably killed a decent human being over nothing. Yanez didn't even really raise his voice before shooting to let Castile know what he was doing that was making him scared. I think he should've at the very least gotten manslaughter. I hope they nail everyone involved in civil court. That poor kid in the backseat! Heartbreaking.

(22,443 posts)Leave his hands where they are, where they're clearly causing Yanez some distress, or pull them out without taking "it" out, risking Yanez seeing something that isn't there? His training was either crap or left him at that moment, and his reaction afterwards shows he knows it, too.

(83 posts)I never thought of it, but you're right. If he'd given a clearer order, something along the lines of "DON'T MOVE!" then Mr. Castile might've survived the encounter, and I'm not blaming Castile at all. Are you a member of law enforcement? I ask because your insight is informed.

stated I had a licensed gun. BUT, BUT, BUT I would have PUT MY FUCKING HANDS ON THE
FUCKING steering wheel and KEPT THEM THERE until the cop told me what to do.
I am in no way this killing was ok rather that people need to be smarter. I am very
sorry for this young mans death.

(53,871 posts)Castile told the cop he had a concealed carry permit and a firearm on him, as one is supposed to do.
On the audio you can clearly hear Castile tell that to the officer.
The killer then told him not to take the gun out but to show him ID and the permit.
When Castile, probably confused as to how to obey contradicting orders, tried to reach for his ID the cop without warning just pumped seven bullets into a car full of people.
IMO that's clearly reckless endangerment of the girlfriend and little girl's lives, not to mention the murder of Castile.

(4,907 posts)This shit will go on and on, no matter how many videos are recorded, no matter how many witnesses. Go back and look at every case where a cop shot and killed someone, in most if not all of the cases they said some form of "I feared for my life."
It sickens me we are going through this in the 21st Century.

The first time Diamond Reynolds watched the dash cam video is when she learned her daughter opened the car door after the shots were fired.
During her prep for trial, Diamond Reynolds said Castile's gun was not visible because his shirt hangs over the front of his pants.
During BCA interview, Yanez's partner, Joe Kauser, says officers not trained on what to do when pulling over someone who has a gun permit.
Two months before shooting #PhilandoCastile, Ofc. Yanez took a two hour de-escalation training.
