He would have to ask for permission after like 60 days. I think Obama avoided asking for permission to get involved in Syria and Congress didn't do anything about it.
He has 90 days free reign.

(26,366 posts)Since then there have Congressional "authorizations for the use of force" and UN Resolutions authorizing the use of force.
The President wasn't suppose to be able to start a war themself, but as commander in chief could repel attacks.

The contemporary state of affairs seems to be that a President can bomb pretty much any country that isn't likely
to shoot back in a significant fashion. So the question now is can and will Congress stop him?

The extent of the President's war making ability is not a fully settled constitutional question.
