Judge cites serious labor violations at Novelis, upholds order to bargain with Steelworkers

Scriba (WSYR-TV) - An Administrative Law Judge has upheld the National Labor Relations Board's findings that Novelis in Scriba committed extraordinary violations of labor law, making it unlikely that a fair election could be held for union representation.

The company is facing an order to bargain with the United Steelworkers Union, even after employees narrowly voted against unionizing last year.

Judge Michael Rosas' decision details a list of unfair labor charges that could have tainted the election, including threats to make working conditions more difficult with a union, demoting at least one pro-union employee, interrogating and coercing employees, and threatening job loss.

The decision reads: "The aforementioned violations constituted overwhelming evidence of conduct by the company during the month leading up to the election which eroded ideal conditions necessary to facilitate the free choice of employees and determine their uninhibitied desires."

The judge in the case mentioned that unfair labor practices were so egregious that they amounted to illegal interference with workers' rights. Mind you, this is New York, not some Southern red state (apologies to Southern DUers) where the judge looks the other way while employers can use, misuse, and abuse workers with near impunity.

Now all we need is to criminalize interfering with workers' right to organize--punishing union busters like drug dealers--and put the union busters behind bars for a long time. That's what I want to see.
