Arizona Says Rape Victim Knew The Risks, Asks For Lawsuit To Be Thrown Out

The Arizona Attorney General's Office filed a motion in a lawsuit this week saying a teacher knew the risks she was taking when she was left alone in an unguarded prison classroom with a convicted sex offender who allegedly raped her, the Arizona Republic reported on Tuesday.

The woman eventually filed a federal lawsuit questioning why she would be left alone with no way to defend herself while teaching a group of sex offenders.

Assistant Attorney General Jonathan Weisbard delivered a motion on Monday to dismiss the lawsuit, the newspaper reported.

"Plaintiff is an ADOC (Arizona Department of Corrections) employee who routinely worked at the prison complex," Weisbard wrote. "By being placed in a classroom at the complex, the officers were not placing Plaintiff in any type of situation that she would not normally face. The risk of harm, including assault, always existed at a prison like Eyman." Weisbard also wrote that there was no proof that the corrections officers were aware of any risk to the teacher.

She had to know this was a dangerous situation. On the other hand, correction officers couldn't possibly have a clue this woman was put in a dangerous situation.

The prison knew the risks. She most likely didn't since they generally don't tell visitors an inmate's conviction history.

Weisbard is grasping at straws. This is the prison's negligence, not the teacher's.

If she had to know it was dangerous, so should have people who put her there. So they should have done something to protect her.
And they didn't do a darn thing. They send a woman to teach a bunch of sex offenders with nobody monitoring what was going on.

arent in some sort of small closet like thing that has shatterproof glass thats connected to the classroom sort of like like how they do it for gas stations that stay open all night in some of the more dangerous neighborhoods where they have a small pass through for items.
You would think it would make sense especially for the safety of the civilians like her.

That day they send her to un-monitored room and gave her a radio that was set on a channel that nobody monitored.

Every once in a while you see an attempt at legal spin that you just know is doomed to make the matter much, much worse for said lawyers' client, as this claim is. No one in his or her right mind would expect that such criminals would be non-supervised in a prison, or that the communications equipment given did not work, etc.

This is going to make the judge mad. Really mad. Really, really provoked. Pissing off a judge is not going to help you.
