Alabama Chief Justice Roy Moore late Sunday ordered all probate judges and employees in Alabama to follow existing state law and not issue marriage licenses to same-sex couples or recognize same-sex marriages.
Couples across the state are preparing to wed Monday morning, when a stay on same-sex marriages is set to be lifted.
On Jan. 23, U.S. District Judge Callie V.S. "Ginny" Granade ruled the state's constitutional ban on same-sex marriage and recognition of same-sex marriages entered in other states was unconstitutional. She issued a stay, putting her ruling on hold until Feb. 9.
... In his order issued Sunday night, Moore wrote that if any probate judge defies the order, Governor Robert Bentley would have the responsibility of ensuring that state law is "faithfully executed."

It's just this idiotic and utterly childish mood toward which our country seems to have devolved - NOBODY tells ME what to do!!!! We see it in the gun nuts who insist that they have a right to parade their damn massacre machines in your face at the local fast-food joint. We see it in the so-called "sovereign citizen" crap. "Nobody tells you what to do?" Then what you want is NOT a democracy, and certainly not the United States of America. What you want is TOTAL ANARCHY!!!

His argument is he's empowered to block anything which could "bring chaos and confusion into the system."
Yeah, like the chaos and confusion of all people having an equal right to the benefits of a legal marriage? What a raging bigot!

(57,936 posts)been a matter for the states. If of course denying people the right to marry based simply on gender is found to be discriminatory or for some other reason in violation of our US Constitution, the Supreme Court will let us know.
This tradition that states decide on same-sex marriage is, in my opinion, wrong, because I do believe that the rights that accrue when we marry should not be denied to us based on our gender or the gender of the person we marry.
After all the rights that those of us who are married enjoy such as income tax deductions, visitation with our spouse in many situations, etc. should not be denied based on our gender. And denying same-sex couples the right to marry is in my view gender discrimination.
There is utterly no reason for denying same-sex couples the right to marry other than tradition and certain religious beliefs which are not shared by all religions. Unitarians joyfully celebrate the marriages of same-sex couples. There used to be a big sign outside my Unitarian church advising all that we celebrate same-sex marriages. Other religions do not have to celebrate if they don't want to. We have freedom of religion, and same-sex couples should not be barred from civil marriage or marriage in a religious faith that celebrates their relationship if that is what they want.

Something has to be done to stop this Constitution-hating excuse for a human being, and disbarment MIGHT work for a couple days...you know, long enough for him to buy a couple new suits, get a facial and a $250 haircut, and map out the route from Montgomery to the Fox News studios.

(82,383 posts)Just because he is CJ of the State SC does not give him power to direct lower court judges or anyone in the government with direct orders. He can only decide cases that come before him.

So, there's only one question left.
Is it whether gay marriage will happen in Alabama?
Please. Already, almost three quarters of the people in this country live in states where same-sex marriage is legal already. Do you think Alabama is going to suddenly change the minds of federal judges, including the United States Supreme Court which has already all but waved a rainbow-checkered flag at the finish line? If the high court didn't intervene with Florida, it won't for Alabama. Don't be ridiculous.
Can the state say to hell with the federal government and do its own thing?

A Sunday night order from Alabama Supreme Court Chief Justice Roy Moore ordering probate judges not to issue marriage licenses to same-sex couples caused confusion at county courthouses this morning.
Probate judges in several counties decided not to issue any marriage licenses at all - to same-sex or heterosexual couples. In some counties, including Butler County, Colbert County and Coosa County probate courts are taking marriage applications from all couples but not issuing licenses.
Officials at Mobile County Probate Court turned away all couples seeking marriage licenses this morning. The couple that sued to overturn the state's ban on same-sex marriage lives in Mobile County, and their attorneys were drafting a motion to compel the court to comply with the federal court ruling, according to Al.com.
In Coffee County, Jefferson County, Etowah County, Chilton County and Madison County, probate judges said they will issue marriage licenses to all couples, gay and straight, on Monday morning.
Couples lined up bright and early Monday outside the probate judge office at the Madison County Courthouse to get their marriage license after the hold on same-sex marriage was denied last week, giving same-sex couples the right to marry in the state of Alabama.
