Chief Justice Roy Moore conceded Monday that the ruling by the U.S. Supreme Court that homosexuals have a constitutional right to marry sets a precedent.
....
Asked if as the state's chief justice he would follow and enforce the law, Moore snapped that judges do not enforce the law. Asked if he expected probate judges and other judges and state officials to obey the law, Moore used examples of men who were judged to have followed wrong and immoral laws and orders in Germany during World War II.
"Could I do this if I were in Nuremberg (war crimes trials after WW II) say that I was following the orders of the highest authority to kill Jews?... Could I say I was ordered to do so?
Told that trial was about killing human beings, not gay marriage, Moore asked: "Is there a difference?"

Ummm, yes there is.
If it weren't for that snip, I'd have let this go as "so what else did you expect him to say?" That comment, though, is remarkable.

(49,533 posts)The key thing to remember here is that in the mind of Roy Moore, and millions like him - NO, there is not. To them, murder and homosexuality are both direct violations of what they see as "god's law" and therefore equally offensive, sinful, and wrong.

(15,036 posts)Both could choose to follow their conscience, but at a price.
For those in Nazi Germany, it meant swift reprisal; imprisonment, death, or something worse -- sent to the Eastern Front.
For those in democratic Alabama, it means having to eventually seek new employment and the loss of their pension.
All in all, seems the dissenters among the Cotton State will have it quite a bit easier than their "counterparts" (Roy Moore's characterization) under the Reich.

(13,871 posts)Moore and his ilk are basically saying, "We don't have to follow laws we don't agree with". Isn't this the kind of thinking that led to the Civil War?

(532 posts)But is there any god-damned reference to homosexuality or marriage in the original constitution? Or the first ten amendments?

(50,560 posts)I joined the Army once and reenlisted twice. I swore to defend the Constitution of the United States against all enemies, foreign and domestic. After seeing a state supreme court judge who doesn't know what the Constitution says, I now know what a domestic enemy looks like.
