FBI aiding inquiry of man's death after police encounter

STONEWALL, Miss. (AP) — Some residents of a small Mississippi town say they're still looking for answers a week after a black man died following a physical encounter with a white police officer.

The Mississippi Bureau of Investigation said Tuesday that it is too soon to discuss how Jonathan Sanders died on the night of July 8 while he was exercising a horse on a two-wheeled buggy.

But local officials told a community meeting in Stonewall on Tuesday that the state and the FBI could hold a news conference in coming days to fill in some of the gaps in the official account Sanders' death.

Mitchell said the case would be presented to a Clarke County grand jury, possibly as early as September, but maybe later. He said he has presented fewer than 15 cases involving a death caused by law enforcement to a grand jury during his 28 years as district attorney of four counties, and can't recall an officer ever being indicted.

A white police has been accused of choking father-of-two Jonathan Sanders (pictured) to death with a flashlight after he dragged him off one of his horses in Stonewall, Mississippi

As Harrington pinned him down in the ensuing struggle, Sanders is believed to have told the officer: 'Let me go. I can't breathe'.

Harrington and a medic who was called to the scene both gave Sanders CPR, but he died a short time later. Charita Kennedy, his girlfriend, claims his family were not allowed to see the body when it was transferred to hospital.

The alleged incident has striking similarities to that of cigarette seller Eric Garner, who died after a cop put him in a chokehold in Staten Island, New York.

Witnesses have told Mississippi state investigators that an unarmed black man died after being kept in a chokehold by a police officer for more than 20 minutes and denied CPR, according to his family’s attorneys, who said an autopsy confirmed he was fatally strangled.

State medical examiners provisionally found Jonathan Sanders died through homicide by manual asphyxiation, according to attorneys Chokwe Lumumba and CJ Lawrence.
Sanders, who was 39, repeatedly told Stonewall police officer Kevin Herrington “I can’t breathe”, according to one witness.

According to the attorneys, one witness alleged that Herrington said he was “going to get that nigger” seconds before confronting Sanders in Stonewall on the night of 8 July, and several said the officer was the aggressor. Police have described the encounter as “a fight”.

The attorneys are requesting that a special prosecutor take over the case, citing remarks at a town hall meeting on Tuesday by Clarke County’s district attorney, Bilbo Mitchell, that he had handled 15 cases of killings by police during his career and none had resulted in an officer being indicted.
