Huckabee On Kentucky Clerk's Jailing: Even Serial Killer Jeffrey Dahmer Got Bail!

Republican presidential candidate former Arkansas Gov. Mike Huckabee said on Friday during an appearance on Fox News that serial killers got better treatment by the American justice system than the Kentucky county clerk who was jailed for refusing to issue marriage licenses to same-sex couples.

Huckabee has been one of the most vocal presidential candidates to defend Rowan County, Kentucky clerk Kim Davis after she was jailed Thursday on contempt of federal court. The ex-governor brought up the comparison to serial killers during an interview on Fox's "America's Newsroom."

"Jeffery Dahmer got bail, the Boston Stranger got bail, John Wayne Gacy got bail," Huckabee said. "Kim Davis, because of her convictions, was not given bail." Huckabee said he will host a rally on Tuesday in Grayson, Kentucky in support of Davis. "What she did was follow the Kentucky Constitution," he said. "This is an unbelievable moment in American history."

Because Huckabee's poll numbers have remained low, Fox News anchor Martha MacCallum asked how he feels about the state of his presidential campaign. "Summer blockbusters never win the Oscars," Huckabee said in a vague insult to current GOP frontrunner Donald Trump.

Bail is for when you've been charged with a crime by complaint or indictment and you are awaiting trial. If the judge thinks you won't skip town or commit another crime in the meantime you'll be let out pending trial if you put up some money, like a bail bond, to ensure your appearance.

The whole point of being jailed for contempt, on the other hand, is to make a person comply with a court order. In this case the judge knew that a fine wouldn't ensure her compliance because the fundies would pay it for her. His job is to see to it that she complies with the order. There's no bail for contempt because that would defeat the entire purpose.

Huckabee is an idiot. But we knew that.

BTW I looked up Jeffery Dahmer's wiki page and was never given bail matter of
fact Dahmer confessed to 16 murders w/in days of his arrest

People get bail before a conviction, because they are presumed innocent until found guilty. Kim Davis has already been found in contempt of court, and so she is serving her sentence for that.

She can go free anytime she wants. When or if that happens is entirely up to her.

You don't get "one month for contempt" of an injunction. You walk as soon as you agree to abide by it.

Being in jail/prison wasn't an automatic outcome; he could have fined her while she continued to defy the ruling, but instead he put her in jail. I think 'sentence' is an appropriate word.

But not in this type of situation where we are dealing with failure to comply with an injunctive order.

For example, in the federal system, 3 months is a typical sentence for contempt.

So if this was a situation where there was a fixed term, then "sentence" would be appropriate.

sentence. She was given another chance to stay out of jail, she turned it down.

It is also becoming apparent Huckabee is standing behind those accused of bad things, he stood up for Joshua Duggar, the reverend is losing his way.

I just looked up Dahmer's wiki page and not only did he never get bail but
he confessed to 16 murders w/in a day or so of his arrest.

Not for their ultimate crimes but for earlier charges. Huckabee is not lying, just distorting and misdirecting. That's what "real" Christians do-deceive purposely but legalisticly protect themselves from breaking a commandment...

I think Mike Huckabee intentionally used Jeffery Dahmmer and John Wayne Gacy as examples because they were serial killers who were self loathing homosexuals. Basically the dog whistle to his wing nut followers is that Gays had more rights than Kim Davis, even serial killing homosexuals.. This is sort of the underhanded slur that the Right Wing are known for..

The whole point is to make a person follow an order of the court, and if the penalty for contempt is jail, it defeats the purpose to grant bail and let him or her out.

There is no "bail" for contempt. It's not a criminal charge.

Anyone being held for contempt of a court order can walk right out of jail for FREE anytime they want to.

I see both Mike Huckabee and Todd Stearnes do these logical fallacies all the time. They try to put square pegs in circle holes. They try to push their lies, (Lincoln defied the Dred Scott Decision, tell that to the Border States that had slavery and remained in the Union, Kim Davis is being punished for her beliefs) They are just bad lies, and easily discounted with empirical evidence..

The idea is that you sit in jail until you decide to obey the judge's order. Either you blink or the judge blinks. That is how it works. May be a crappy system but what is the alternative? If people can just disobey a lawful order from a judge there is no rule of law.
