Judge orders resentencing for Indiana teen in sex case

NILES, Mich. (AP) A judge has ordered a resentencing for a 19-year-old from Indiana who had to register as a sex offender in two states because he had consensual sex with a 14-year-old Michigan girl he met online who lied about her age.
The ruling in Zach Anderson's case was released Tuesday by Berrien County District Judge Dennis Wiley, the South Bend Tribune reported.
Wiley cited comments a prosecutor made at Anderson's original sentencing in April as the reason why the teen's fate now will go before a different judge.
Anderson, of Elkhart, Indiana, was jailed and given a five-year probation that includes a stipulation that he stay at least 1,000 feet from schools. He isn't allowed to use computers or the Internet. Anderson also faces 25 years on Michigan's sex-offender registry and would have to register as a sex offender in Indiana once his sentence is completed.

(8,401 posts). . . and while many people will respond that parents need to teach their sons to be "absolutely sure" about the age of any potential sex partner, the fact of the matter is that people -- much leass horny teenagers -- simply don't operate this way in their interpersonal interactions.

(22,000 posts)Had the girl been 16 no one probably would have sneezed over it. The one size fits all sentencing guidelines in most states pretty much guarantees the elder of the two (in most cases the male) ends up with a record and sex offender registration for life.
At least if he's given the chance under the provision mentioned in the article he could eventually get his record clean.

Now the above Map had Pennsylvania at 18, when I know it is at 16, but the wikipedia cite for North America age of consent has it correct at age 16:

Now in the mid 1800 there was a push to increase the age of consent above the age of 12. Today, in my home state of Pennsylvania the Age of Consent is 16 UNLESS both parities are within four years of age of each other, then it is 14.
