Judge denies appeal from Utah inmate facing firing squad

SALT LAKE CITY (AP) — A judge denied an appeal Friday from a Utah death row inmate who argued that his sentence of death by firing squad is cruel and unusual punishment.

U.S. District Judge Dee Benson wrote in his ruling that the U.S. Supreme Court has never overturned a state's chosen method of execution as cruel and unusual, though he said inmate Ron Lafferty can still press his claims in Utah state court.

Utah recently approved the use of a firing squad as a backup if lethal injection drugs are unavailable.

Lafferty, 74, had argued that the firing squad would cause a lingering, unnecessarily painful death. He chose to die that way when he was sentenced 30 years ago and such a choice was available, but his lawyers now argue that he wasn't legally competent to do so.

Lafferty is the longest-serving death row inmate in Utah and one of the inmates who is closest to a possible execution date. He was convicted in the 1984 deaths of his sister-in-law, Brenda Lafferty, and her baby daughter. He claimed the killings were directed by God because of the woman's resistance to his beliefs in polygamy.

No matter how evil this scum is, the time to end capital punishment arrived so long ago. The U.S. has surrendered civilization to the control of primitive, self-absorbed low-lifes who want to exercise power over the lives of others any way they can. They are the ones who claim to want "really small government."

They want "small" government only when Democrats are in charge, and they don't intend to share, ever again. Democracy is poison to right-wing lunatics.

For anyone who doesn't know what kind of clown this man is, has been, and his right-wing brother, here's their story:


  • Utah couple became obsessed with killer polygamist cult leader and visited him in jail before poisoning themselves and their kids
  • Kristi Strack and her husband Benjamin and three of their children, Benson, 14, Emery, 12, and Zion, 11, were found dead September 27
  • The couple had spent years obsessing over jailed killer and polygamist radical Dan Lafferty prior to the slayings
    Dan along with his brother Ron were convicted of murdering their sister-in-law and her baby in 1984
  • The Stracks killed themselves and their three kids with a lethal cocktail of medication -- they were found by Kristi's eldest child from another marriage
  • Authorities believe the parents took their lives because they wanted to escape 'impending doom'
  • Police don't believe the couple got their beliefs from Lafferty, but his ideology of a '1,000-year' sex romp upon God's return appears suited for the Stracks' drug struggles
