Judge blocks Missouri from pulling clinic's abortion license

Source: AP/KOMU

COLUMBIA (AP) — A federal judge has temporarily blocked Missouri's health department from revoking the abortion license held by a Planned Parenthood clinic in Columbia.

The temporary restraining order issued Monday by U.S. District Judge Nanette Laughrey is set to expire Wednesday evening, following another hearing.

Planned Parenthood of Kansas and Mid-Missouri filed a federal lawsuit Monday to preserve the Columbia clinic's abortion facility license from the Missouri Department of Health and Senior Services.

The department had planned to revoke the license Monday evening, leaving the St. Louis Planned Parenthood the only facility in the state where abortions can be performed.

4. The Supreme Court took up the Texas law case - I don't see how these state laws can be upheld by SC

Roe v. Wade has been the law for 4 decades.

The Supreme Court has allowed for some regulation (parental consent) but has also said states cannot impose an "undue burden" on the right to end a pregnancy.

These state laws requiring hospital privileges impose an undue burden. Not clear what the benefits are - if anything it would have been more legitimate to require this 40 years ago - there is a mountain of evidence now that procedures can be done without need for upgraded surgical facility or hospital privileges.

The percentage of cases with complications must be very small - there is data available to prove that. Additionally, to the extent there is a complication, the patient can be transported to a hospital - you just need to go to an ER. You don't need a doctor with privileges in order to go to a hospital.
