Officer says he told boy to show hands before fatal shots

CLEVELAND (AP) -- A white Cleveland police officer who fatally shot a 12-year-old black boy carrying a pellet gun told investigators that he continuously told the boy to show his hands before he fired.
Prosecutors on Tuesday released statements that the rookie patrolman and his training officer gave investigators after Tamir Rice's shooting just over a year ago.
A grand jury is hearing evidence on whether patrolman Timothy Loehmann should be charged criminally for killing the boy outside a Cleveland recreation center.
In his statement, Loehmann described in detail actions that a surveillance video shows took about two seconds.

(34,136 posts)The cop is lying - there was no time for him to tell Tamir Rice anything. Even if he'd yelled out the window of the cruiser as they pulled up there was no time for Tamir Rice to comply.
Two seconds is far too short a time to make a determination to kill a child.

The driver put them into a potentiality dangerous position, the shooter was ready to shoot before they stopped.

Garmback said he saw the gun at around the time that Loehmann got out of the police car, and he thought it was a handgun. Garmback said he and Loehmann told Tamir to show his hands.

(14,177 posts)I have seen more than my share of people whittling in fact growing up I did that on occasion. There isn't much entertainment in the sticks, unless you are carving them that is.

Cops are jumpy as hell, and it's not without reason. The remote possibility of Islamic Terrorism, and the real possibility of Yahoos with concealed semi-automatic weapons.

(115,677 posts)He also said that barriers at the park's main entrance prevent cars from getting into the park. Garmback said that he drove over the curb and across the grass because he did not see Tamir at the swings.
Loehmann wrote that he opened the door and yelled "show me your hands" as the cruiser approached Tamir. He repeated the order as Tamir reached into his pants, he said.
"I saw the weapon in his hands coming out of his waistband and the threat to my partner and myself was real and active," he wrote.

(6,241 posts)Loehmann, who was identified as having fired the shots that killed Rice, joined Clevelands police force in March 2014. Previously, he spent five months in 2012 with the police department in Independence, Ohio, about 13 miles south of Cleveland, four of which were spent in the police academy. According to his personnel records, released by the city of Independence in the aftermath of the shooting, his supervisors described him as an emotionally unstable recruit with a demonstrable lack of maturity and an inability to perform basic functions as instructed, specifically citing an incident that occurred during a weapons training exercise.
An internal memo sent by Independence Police Departments deputy chief to the citys human resources manager described Loehmann as visibly distracted and weepy during gun range training and exhibiting a dismal performance in handling his gun, calling the incident a dangerous loss of composure. The memo concluded, Individually, these events would not be considered major situations, but when taken together they show a pattern of a lack of maturity, indiscretion and not following instructions, I do not believe time, nor training, will be able to change or correct these deficiencies.
