Hundreds of Porter Ranch's gas leak-weary residents gathered to consider legal options

Hundreds of Porter Ranch residents gathered in Granada Hills Tuesday evening for a meeting organized by a team of lawyers suing the Southern California Gas Company over an ongoing leak from a storage facility.

The legal team filed the lawsuit last week as a class action, which means that residents of the area will have the opportunity to join the case as plaintiffs, or opt out of the class. The Los Angeles City Attorney announced Monday that the city is filing a separate suit seeking court oversight of the Gas Company's actions to stop the leak and prevent others.

City Files Suit Over Porter Ranch Gas Leak

Residents have complained of a noxious smell and ailments including nause and headaches. The main component of natural gas, methane, is odorless, so as a leak indicator, a strong-smelling chemical — mercaptan — is added.

Natural gas is also invisible in normal light, but does appear in infrared imagery, according to Paul Rosenfeld, an environmental chemist retained by the legal team.

During the meeting, the audience was shown what was described as infrared video of the sky above Porter Ranch and told that the plume, varying in color from pink to blue, represent varying concentrations of hydrocarbons.

Natural Gas Leak from Well Described as "Catastrophe"

"The video looks like something out of a science fiction horror movie," said Brian Panish, a member of the legal team. Others include R. Rex Parris, the firm of Morgan & Morgan, and Robert F. Kennedy, Jr., who recently moved to California.

Kennedy asserted the leak could have been prevented had the entire well been encased in concrete, as has been required since legislation in the 1970s. The leaking well dates back to a postwar oil field that was pumped out and later converted to natural gas storage.

Hinkley's residents also noticed that there was no rationale behind how much money each resident received, but the rules of private arbitration prevented them from finding out the formula used to determine the settlements.

They regularly do excellent comedy-skits.
They regularly do comedic image-contests.

They regularly do (well-)researched articles. You can freelance to write for them, but they demand that your article be properly sourced. (Wikipedia is explicitly outlawed.)

They rarely do articles written by anonymous authors on things like living in a warzone, being a criminal, being abused, being a drug-addict, being afflicted with a serious and rare disease... They recently had an article by an anonymous muslim woman on muslim honor-killings and how her parents would actually kill her if they ever find out what her private life is really like.

They very rarely do articles that are purely comedic and satiric. (And they suck. Those authors just aren't funny.)

These cases are not slam dunks. The judge or arbitrator may decide to throw the case out. The burden of proof that the plaintiffs must satisfy has been raised in most instances thanks to Tort Reform, something your comments would seem to indicate you would support. Many of the potential jurors out there don't indicate that they want to get on the jury just to make sure the plaintiffs get nothing no matter how strong their case is. Work your ass off for 3-4 years and sink ten million in something only to lose it all and see if you think this is unfair to the plaintiffs.

The firm pays the expenses and only gets it back if the recover, so that $10,000,000 in expenses was used to prove the case and came out of the firm's pocket. All of this would have been in the contract that each plaintiff signed so don't act like the firm suddenly took to money they weren't entitled to. Unlike the defense attorneys who get paid by the hour, the firm has to pay for everything and risks losing it all, not to mention all of the time which is the only thing they have to sell.

I have watched Americans rights erode steadily over the last 25 years and most have no clue. Corporations have stacked the deck with conservative judges and justices to make it next to impossible to get and keep a verdict. In Texas, the Texas Supreme Court rules in favor of corporations vs. individuals about 90% of the time. The 5th Circuit Court of Appeals in New Orleans has about the same percentage for the Federal Courts and they have consistently sided with BP on multiple rulings on the BP oils spill litigation (farce)! Americans need to learn more about our civil legal system and what is going on, and stop demonizing trial lawyers unless they truly deserve it (some absolutely do)!

...When it subsided enough to go out and check the oil and gas wells and facilities there was still a lot of standing water, and they found gas bubbling up all over the place, even old closed up sites.

A civil lawsuit was filed Monday against the Southern California Gas Co. by Los Angeles City Attorney Mike Feuer, with city officials alleging the Aliso Canyon gas leak has threatened residents’ health and hurt the environment.

Filed in Los Angeles Superior Court on behalf of the people of California, the lawsuit alleges a public nuisance and violation of the California Unfair Competition Law from the leak.

Feuer said he would seek civil penalties for the leak, which was made public by gas officials in October. The leak at Aliso Canyon is occurring outside Los Angeles city boundaries but affecting residents of nearby Porter Ranch.

“No community should have to endure what the residents of Porter Ranch have suffered from the gas company’s continued failure to stop that leak,” Feuer said.

The lawsuit comes days after Porter Ranch residents filed their own lawsuit against the gas company over the fissure, which isn’t expected to be fixed for several months.

Feuer’s complaint alleges gas officials created conditions that “allowed the well to fail, exacerbating the effects of that failure by allowing the acute odor and health problems faced by the community to persist for more than one month, to say nothing about the indefinite time it will persist into the future.”

The leak is spewing 100,000 pounds of methane every hour, according to the lawsuit, which will result in “increased temperatures and extreme heat days for the city well into the future” because of methane’s “potent warming effect.”

County public health officials said prolonged exposure to trace chemicals, some of which are known carcinogens, in natural gas leaking above Porter Ranch can cause long-term health effects.

However, they cautioned Wednesday that the levels examined so far in Porter Ranch are not believed to be associated with long-term health problems.

Previously, county health officials said the gas leak did not pose any long-term health risks, but because the leak is now entering its sixth week and gas company officials say it may take four months to plug the leak, officials said more monitoring is needed.

“As the duration of exposure increases, these trace levels can produce significant long-term health effects,” county Department of Public Health Interim Director Cynthia Harding wrote in a memo sent Tuesday to the Board of Supervisors. “As this incident has moved from a short-term exposure event resolved within days, to now a long-term event potentially lasting months, supplemental monitoring of potentially harmful trace chemicals is warranted.”

The massive gas leak that started more than a month ago near Porter Ranch continues unabated as Gov. Jerry Brown prepares to take the international stage at the United Nations climate conference in Paris. Yet Gov. Brown’s weak response to the ongoing crisis at the Aliso Canyon Storage Field proves he is a lot more talk than walk when it comes to fighting climate change at home.

Once an oil field, Aliso Canyon near Porter Ranch was repurposed for gas storage in the 1970s when most of the oil was gone. Now, it is one of the largest such facilities in the country with the capacity to store 86 billion cubic feet of gas. The field stores fracked natural gas that is piped in from across the Western United States to Los Angeles, where it is then pumped into wells to store the gas underground.

The leak that started on Oct. 23 was caused by well integrity failure and is only the most recent of many such leaks caused by aging infrastructure. SoCalGas admits in its own documents that it’s seen a “negative well integrity trend” develop since 2008 and has observed wells reaching a breaking point. Most of SoCalGas’ wells are more than 50 years old, and many are over 80. As these wells crumble due to old age and high-intensity use, residents are put at a greater risk of accidents, well blowouts and other major incidents. Alarmingly, despite these dangers, SoCalGas plans to increase storage capacity at this field putting further stress on these old wells.

But instead of showing strong leadership, Gov. Brown has left it to the state’s Department of Oil, Gas & Geothermal Resources (DOGGR) to address the leak. DOGGR — under fire already for enabling oil drillers to threaten California’s depleted freshwater aquifers during a drought crisis — unsurprisingly gave SoCalGas a pass by only requiring the influential corporation to tell the state its timeline for stopping the leak. This is unacceptable: Instead of leaving it to SoCalGas to look after the atmosphere and the health of Porter Ranch families, Gov. Brown should use his executive authority to shut down the Aliso Canyon Storage Facility. That’s what a real climate leader would do.

Tragically, a leak like the one that continues at SoCalGas’s facility near Porter Ranch could happen anytime and anyplace where fracked natural gas and oil are stored or where these fossil fuels are extracted. Shutting down the Aliso Canyon Storage Facility should be an easy decision for Gov. Brown, and one he should make immediately. But, in the big picture, that action is one small step: to be a real climate leader, and to truly protect Californians, Gov. Brown must ban fracking and other extreme forms of oil and gas extraction, and quickly transition the Golden State off fossil fuels to 100 percent, real, clean, renewable energy.

LOS ANGELES — The Los Angeles city attorney sued the Southern California Gas Co. on Monday over a six-week-old natural gas leak that has sparked complaints of illness and forced hundreds of families out of a San Fernando Valley neighborhood.

The Superior Court lawsuit alleges unfair competition and creation of a public nuisance.

“No community should have to endure what Porter Ranch residents have suffered,” City Attorney Mike Feuer said in a statement. “It’s not only the odor — it’s the potential health issues from long-term exposure to chemicals including benzene; the impact on the daily lives of thousands of families; and the enormous greenhouse gas emissions that remain unmitigated.”

The leak began around Oct. 23 with a well failure at the gas company’s Aliso Canyon site, where natural gas is stored in a vacant underground oil field. It is believed to be the largest natural gas storage facility in the West and is capable of supplying all of Southern California for more than a month.

The lawsuit contends that the leak in the Porter Ranch area could have been avoided if the gas company had “established and promptly implemented appropriate contingency plans” for a leak. It also alleges the company illegally waited days to notify authorities.

It wants the court to order the leak quickly repaired, plans made to prevent a recurrence, and fine the utility up to $2,500 per day for violations.

...Based on measurements of pollutants in the atmosphere, the California Air Resources Board estimated the rate of gas escape at approximately 50 tons an hour, roughly one-fourth of all the greenhouse methane gas being released from the entire state of California.

Last week, SoCalGas began drilling what is known as a "relief" well to provide access to the well that failed, said spokesman Javier Mendoza. It is a process that the company said could take several more months.

Because natural gas is flammable, work around the leak area requires extensive precautions against fire.

Wednesday afternoon, SoCalGas plans to provide an update, and allow news media to send a photographer to the work site.

PORTER RANCH (CBSLA.com) — The Federal Aviation Administration is banning low-flying planes over the gas leak near Porter Ranch.

The agency said in a statement that the temporary flight restrictions were requested “out of concerns that fumes from the gas leak could be ignited.”

The restriction, according to KNX 1070 NEWSRADIO, prohibits aircraft from flying below 2,000 over the area.

Flights under the direction of the Los Angeles County Fire Department are exempt.

The ban, which has a 0.5-mile radius and extends to 2,000 feet altitude, is not expected to affect commercial flights.

Citing safety concerns, the Federal Aviation Administration has temporarily banned low-flying planes above a section of Porter Ranch affected by a gas leak.

The restriction applies to planes flying below 2,000 feet and is expected to remain in place through at least March, according to an FAA document, which was issued Wednesday.

Meanwhile, state regulators Thursday ordered Southern California Gas Co. to provide detailed plans and schedules for how it will plug a natural gas leak that has sickened and displaced scores of San Fernando Valley residents.

The utility has come under fire for its handling of the leak, drawing lawsuits, a citation from air quality regulators over the odor and sharply worded rebukes from officials across the region.

They have moved into temporary shelters. Gas was making them sick.


And note - Gov Brown's sister Kathleen Brown is on Sempra's (owner of SoCalGas) board as well as Lynn Schenk, one of Brown's closest advisors.



Brown needs to be recalled over his handling of this.

California regulators are taking precautions so that crews do not ignite leaking methane gas as they work to plug a defective well north of Los Angeles, the state’s oil and gas supervisor said Tuesday.

Steve Bohlen, director of the state Division of Oil, Gas and Geothermal Resources, said the precautions include keeping engines, drills, cellphones and other ignition sources at a distance from the leaking Southern California Gas Co. well.

The well is releasing a large amount of methane, a potent greenhouse gas, and has sickened residents.

Special care is needed because “natural gas is escaping, venting from around the well and mixing with the oxygen in the atmosphere,” Bohlen said. He said that the methane being released poses a threat to about 100 workers at the site, but not the general public.

Southern California Gas has been under scrutiny as the leak detected Oct. 23 at its Aliso Canyon storage field has dragged on for more than seven weeks, generating a flurry of complaints from San Fernando Valley residents and reports of nausea, headaches, nosebleeds and other health problems in nearby Porter Ranch.

Under orders from the L.A. County Department of Public Health, 1,675 households affected by odors from the leak have been relocated at the gas company’s expense.

Officials with the governor’s Office of Emergency Services said Tuesday that they have not issued evacuation orders because there is no clear public safety hazard to nearby residents. The nearest homes are more than a mile from the leaking well.

The Los Angeles County Board of Supervisors on Tuesday declared a state of emergency over a Southern California Gas Co. leaking well site above Porter Ranch that has pumped up to 1,200 tons of methane into the atmosphere.

The county declaration, proposed by Supervisor Michael Antonovich, whose district includes the massive Aliso Canyon natural gas storage facility, paves the way for state and federal assistance and was approved unanimously.

“This action will seek state and federal assistance for our residents in the Porter Ranch area with additional air monitoring and help with efforts to cap the well,” Antonovich said in a statement. “The residents ... have suffered for more than 50 days since the gas leak was discovered.”

The supervisor noted that 88 air purifiers have been installed in the community and 275 have been scheduled for installation in the area.

LAUSD works to close two Porter Ranch schools over gas leak

Los Angeles Unified School District officials were preparing Wednesday to close two elementary schools affected by a natural gas leak in Porter Ranch as many parents expressed rising fears over their children's health.

The Board of Education is scheduled to consider a proposal Thursday to relocate students and staff temporarily from Porter Ranch Community School and Castlebay Lane Charter School to other district sites when classes resume after the winter break.

A number of steps have already been taken, including placing air filters in every classroom, adding more nurses and conducting air quality monitoring at the two campuses, district officials said.

But odors from the gas leak are distracting students and impeding learning, said a statement issued by school board member Scott M. Schmerelson and Northwest Supt. Vivian Ekchian.
