6 states sue Obama administration over Affordable Care Act

MADISON, Wis. (AP) Six states filed a new lawsuit Wednesday against the Obama administration over the Affordable Care Act.
The complaint that Texas, Wisconsin, Kansas, Louisiana, Indiana and Nebraska filed in the Northern District of Texas takes issue with the Health Insurance Providers Fee assessed to health insurers to cover federal subsidies.
The lawsuit says nothing in the Affordable Care Act's language provided clear notice that states would also have to pay the fee.
"This notice was not even provided by rule but was ultimately provided by a private entity wielding legislative authority," the suit says.

(2,389 posts)Thanks to the ACA, poor and middle-class people are priced out of insurance, AND penalized if they don't buy it. Rates and deductibles have gone through the roof, now that Obama and Co. have given insurance companies free reign to rip us off.
Before anyone says, "Expanded Medicaid," that's just a present that's been handed to those living in blue states. For the rest of us, that's only a dream that we'll never see. An amazing "coincidence" that the language of the ACA was written in such a way, that the Supreme Court could strike down expanded Medicaid by letting the states decide on it.
I see so many people around me who used to be insured, but aren't anymore, because the tax penalties are more affordable than the "affordable" "care" act. It should be called the Unaffordable Who-cares Act, for all it's helped the majority of people.
That's why we need Medicare for all...because the ACA is just a prize package for insurance companies.

yeah yeah, this is texas, I get that, but why have the providers stopped offering a PPO?
there is a lot that is really bad about ACA. But those of you in Blue states can only sing it's praise while we in red states suffer a slow death.

(23,344 posts)That puts it in the Fifth Circuit Court of Appeals. Just the place for right wingers to file, if they think the Supremes will split 4-4.
The right wing will avoid the Ninth Circuit like the plague.

(14,174 posts)All those middle and poor income people in Red States that lost or cannot afford insurance because their Republican overlords refused expanded Medicaid, will be all ears to a cheaper and universal Single Payer solution.

(39,215 posts)voted for Rs in all offices blame us because we did not. As long as we continue to think the Rs are going to save us we will not get anything good in those states. Those of us in blue states cannot do anything about the situation in the red states - it is up to the voters in those states.
The one thing I have been doing to help is find truly progressive candidates from some of these states and donate to their campaign. And I support Bernie and want a SCOTUS nominee who supports single payer.
Too many voters have sold us down the river since 1980 and we not have things like gerrymandering and voter restrictions that make it impossible to change.
I just hope we can change these things.
