Suit filed against Duke Energy, FP&L over customer charges for unbuilt Florida nuclear plants

A federal class action lawsuit filed in Florida seeks to bar Duke Energy from collecting more than $1.3 billion from customers to pay for abandoned nuclear projects.
It seeks to force Duke to repay money already collected and asks for unspecified damages for “unjust enrichment” and other alleged violations of federal law.
The suit says Duke Energy should not be able to charge Florida customers upgrades at the now shuttered Crystal River plant (above) or for pre-construction costs a the Levy County nuclear plant Duke has decided not to build.
The same lawsuit makes similar claims against Florida Power & Light, seeking to prevent recovery of more than $814 million by that utility, repayment of charges already paid and damages.
The suits, filed Monday by a Seattle law firm, involve Duke’s $20 billion Levy County nuclear plant, which it has suspended work on, a $1.8 billion upgrade at its now shuttered Crystal River nuclear plant and Florida Power & Light’s $20 billion Turkey Point nuclear plant, for which FP&L is still seeking a license from the U.S. Nuclear Regulatory Commission.
