Ted Cruz is US citizen, judge rules

A judge in New Jersey has ruled that Republican presidential hopeful Ted Cruz is a "natural-born citizen" under the US constitution and may run in the state's primary elections in June.
A group of residents had challenged the Texas senator's eligibility for the presidency. He was born in Canada to a Cuban father and American mother.

On Tuesday, Judge Masin dismissed the challenge, while acknowledging that "absolute certainty as to this issue is only available to those who actually sat in Philadelphia and themselves thought on the issue".
"The more persuasive legal analysis is that such a child, born of a citizen-father, citizen-mother, or both, is indeed a 'natural born citizen' within the contemplation of the constitution," he wrote in a 26-page decision.

'Judge Masin added that his decision might be adopted, modified or rejected by Lt Gov Guadagno, New Jersey's secretary of state, who is authorised to make a final decision on the matter. She must transmit the names of candidates to appear on the primary ballot to county clerks by Thursday.'

(50,950 posts)It has been cited that he was born in Canada at a time that dual citizenship was not permitted. Since there is not documentation via the consular office by his mother he would most likely be a Canadian. This is in addition to her being registered to vote in Canada as a Canadian citizen.
Why wouldn't he be a citizen of any country? If he isn't American and he renounced his Canadian citizenship he has nothing left.
He is an illegal immigrant.

(953 posts)My thinking, for what it's worth, is that 'natural-born' referred to
people born within the borders of the US colonies before the revolution,
in other words they wanted to exclude people born on foreign soil
before or after the revolution and founding of the United States.
I don't think Cruz is eligible. Alexander Hamilton wasn't eligible.
They wanted to exclude foreigners! Ferners!

A judge in New Jersey ain't the ultimate decider. If we regarded the Constitution in the strict constructionist method favored by Cruz, he would NOT be eligible.
Also, there's some question as to whether his parents were Americans when they had that little shit. They were both on the Canadian voter rolls at the time of his birth. Wassup wit dat?

Thank you for your Ted Cruz, but will you take him back now for a Mackintosh's toffee bar and some doughnuts? He probably won't go very far in your political system, which seems a lot more reasonable than ours. And he's worth a lot less than a toffee bar.

(466 posts)New Jersey only allows people who are eligible to be president to appear on the ballot. Judge Masin ruled that Ted Cruz is allowed to be on the ballot in New Jersey. This doesn't really settle anything; a state judge in New Jersey is not going to be the one who ultimately decides how to interpret the constitution.
